OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

• a.Copy of PAN Card.
• b.Copy of GSTIN.
• c.Copy of Cancelled Cheque.
• d.Copy of EFT Mandate duly certified by Bank.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

• 4.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.
• 5.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

Nominated Inspection Agency: On behalf of the Buyer organization, any one of the following Inspection Agency would be conducting inspection of stores before acceptance: Pre-dispatch Inspection at Seller Premises (applicable only if pre-dispatch inspection clause has been selected in ATC): NA Post Receipt Inspection at consignee site before acceptance of stores: Board of Officer

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Bidders can also submit the EMD with Account Payee Demand Draft in favour of GE (South West) New Delhi-03 payable at GE (South West) New Delhi-03 . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Successful Bidder can submit the Performance Security in the form of Account Payee Demand Draft also (besides PBG which is allowed as per GeM GTC). DD should be made in favour of GE (South West) New Delhi-03 payable at GE (South West) New Delhi-03 . After award of contract, Successful Bidder can upload scanned copy of the DD in place of PBG and has to ensure delivery of hard copy to the original DD to the Buyer within 15 days of award of contract.

Buyer Added text based ATC clauses

• 1.Please submit undertaking to the effect that bidder firm has not been bla cklisted/ barred by any of the department/PSU/Govt undertaking for future trans action.
• 2.ePBG must be uploaded on GeM portal within 15 days of issuing Supply O rder.
• 3.Bidder to submit genuinness certificate for the documents submitted by hi m/her. If bidders submitted any fake documents department will take legal acti on against the bidder/ firm as per Government Rules. If bidder fails to submit a ny documents, the buyer has to right to reject bids without assigning any reaso ns there over.
• 4.Undertaking certificate that the firm of the bidder should not be under liq uidation, court receivership or similar proceedings, should not be bankrupt.
• 5.Non-compliance of bid terms, non- uploading off required documents, lac k of clarity of the specifications, contradiction & supporting literature etc. may l ead to rejection/ disqualification.
• 6.Prospective bidders shall quote for the makes/ brands approved by E-in-C ’s Branch/ HQ Command in Group –I & II category and must upload product app roval letter of aforesaid authority along with Technical bid Documents.
• 7.Bidder has to upload scanned copy/ proof of the DD alongwith bid and ha s to ensure delivery of hard copy to the buyer within 5 days of the Bid End Date/ Bid opening date.
• 8.Successful bidder shall provide genuineness certificate of the product at t he time of supply of the material to the consignee.
• 9.Experience of certificate of supply of similar material, firm should have at least 3 Government orders last 3 years to Government Services.
• 10.It is mandatory to attach all products offering BOQ manuals with specifica tion in technical part of the bid alongwith other mandatory documents.
• 11.Startup bidders are required to submit valid startup certificate from register govt agency of Ministry of Finance.
• 12.OEM Turnover and OEM authorization must be uploaded by bidders.
• 13.Any item quoted by seller at freaskily low rate i.e, found abnormally low i n rate analysis, will have to be supplied in full quantity. The payment of rest of i tems will be done only after delivery of freaskily low rated items in full quantity. Following makes/brands are to be quoted Cera/Kerovit/Hindware/Prayag/Shakti or any other make/brand approve d by Command HQ/ E-in-C Branch. .

Participation by the bidder in RA process would be considered as their consent for extension in offer validity by 30 days by the date of RA initiation.
