OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

• 2.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.

Bidders can also submit the EMD with Account Payee Demand Draft in favour of PRINCIPAL ITI VASAD payable at VASAD . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any responsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is lower), subject to the maximum of quoted GST %.

• 1.Supply as per Specifications The bidder shall be required to supply all items/materials strictly in accordance with the specificati ons mentioned in the Additional Terms & Conditions (ATC) of the bid.
• 2.Gujarat State Procurement Policy, 2024 This bid shall be governed by the Gujarat State Procurement Policy, 2024, published by the Industrie s and Mines Department, Government of Gujarat. Bidders are advised to carefully examine the applicable provisions of the Gujarat State Procurement Po licy, 2024, including provisions relating to: EMD Exemption Start-up provisions Purchase Preference MSE provisions Other applicable benefits/exemptions
• 3.Clarification Regarding EMD Exemption EMD exemption shall be applicable as per the provisions of the Gujarat State Procurement Policy, 2024. Th e bidder claiming exemption shall submit the relevant valid documents, as applicable:
• a)MSE: Valid Udyam Registration Certificate and NSIC/CSPO Certificate for the particular item/product.
• b)Start-up: Valid DPIIT Startup Certificate, Udyam Registration, and NSIC/CSPO Certificate for the particular i tem as an MSE.
• c)GeM Verified Vendor Assessment: Sellers having GeM Verified Vendor Assessment for the particular item.
• d)Other eligible categories: Any other enterprise/organization eligible for EMD exemption as per Clause 4A of the Gujarat State Pr ocurement Policy, 2024 (Page No. 06).
• 4.ePBG The ePBG shall be applicable as per the Gujarat State Procurement Policy, 2024, as follows: Category ePBG - ePBG Enterprises/Organizations exempted from EMD and purchase value up to ₹5 Lakh - Exempted Enterprises/Organizations exempted from EMD - 3% of Order Value All other enterprises - 5% of Order Value
• 5.Precedence of Gujarat State Procurement Policy, 2024 In case of any conflict between the terms and conditions specified in this bid/ATC and the provisions of the Gujarat State Procurement Policy, 2024, the provisions of the Gujarat State Procurement Policy, 2024 shall prevail. However, where any provision of the ATC has no corresponding provision in the said policy, the relevan t ATC provision shall prevail.
• 6.Turnover of the Bidder The minimum average annual financial turnover or actual production of the bidder during the last three fi nancial years, ending on 31st March of the previous financial year, shall be at least twice the bi d value. The bidder shall upload documentary evidence in the form of: Certified Audited Balance Sheets for the relevant financial years; or A certificate issued by a Chartered Accountant (CA)/Cost Accountant, indicating the financial turnov er or actual production details for the relevant period. In case the date of constitution/incorporation of the bidder is less than three years old, the average financi al turnover or actual production for the completed financial years after the date of constitution/incorporatio n shall be taken into consideration.
• 7.Compliance with Minimum Specifications The products supplied must strictly comply with the minimum specifications prescribed in the bid/co rrigendum. Any offer/product deviating from the prescribed minimum specifications shall not be considered for fur ther proceedings.
• 8.Self-Declaration Regarding Blacklisting/Debarment/Banning The bidder shall submit a Self-Declaration confirming that: The bidder is not bankrupt; and The bidder has not been blacklisted, debarred or banned by any Government Authority, whether Sta te or Central, or by any Public Sector Organization.
