The tenderer must have minimum average annual contractual turnover of [V/N or 'V' whichever is less; where V = Advertised value of the tender in crores of Rupees N= Number of years prescribed for completion of work for which bids have been invited. The average annual contractual turnover shall be calculated as an average of "total contractual payments" in the previous three financial years, as per the audited balance sheet. However, in case balance sheet of the previous year is yet to be prepared/ audited, the audited balance sheet of the fourth previous year shall be considered for calculating average annual contractual turnover. The tenderers shall submit requisite information as per Annexure-VIB, along with copies of Audited Balance Sheets duly certified by the Chartered Accountant/ Certificate from Chartered Accountant duly supported by Audited Balance Sheet.

- The tenderer must have successfully completed any of the following during last 07(seven) years, ending last day of month previous to the one in which tender is invited: Three similar nature of works each costing not less than the amount equal to 30% of the advertised value of the tender, or Two similar nature of works each costing not less than the amount equal to 40% of the advertised value of the tender, or One similar nature of work each costing not less than the amount equal to 60% of the advertised value of the tender.
- In case of tenders for composite works (e.g. works involving more than one distinct component, such as Civil Engineering works, S&T works, Electrical works, OHE works etc. And in the case of major bridges - substructure, superstructure etc.), the tenderer must have successfully completed any of the following during last 07 (seven) years, ending the last day of the month previous to the one in which tender is invited: Three similar nature of works each costing not less than the an amount equal to 30% of the advertised value of each component of the tender, or Two similar nature of works each costing not less than the amount equal to 40% of the advertised value of each component of tender, or One similar nature of work each costing not less than the amount equal to 60 % of the advertised value of each component of the tender. Note for b(i): Separate completed works of minimum required values for each component shall also be considered for fulfillment of technical eligibility criteria. (b)
- In such cases, what constitutes a component in a composite work shall be clearly predefined with estimated tender cost of it, as part of the tender documents without any ambiguity. (b)
- To evaluate the technical eligibility of the tenderer, only components of work as stipulated in tender documents for evaluation of technical eligibility shall be considered. The scope of work covered in other remaining components shall be either executed by the tenderer himself if he has work experience as mentioned in clause 7 (a) (ii) of Part-II of GCC or through subcontractor fulfilling the requirements as per clause 7 of Part-II of GCC or jointly i.e., partly himself and remaining through subcontractor, with prior approval of Chief Engineer in writing. However, if required in tender documents by way of Special Conditions, a formal agreement duly notarised, legally enforceable in the court of law, shall be executed by the main contractor with the subcontractor for the component(s) of work proposed to be executed by the subcontractor(s), and shall be submitted along with the offer for considering subletting of that scope of work towards fulfillment of technical eligibility. In case after the award of the contract or during the execution of work it becomes necessary for the contractor to change subcontractor, the same shall be done with subcontractor(s) fulfilling the requirements as per clause 7 of Part-II of GCC, with prior approval of the Chief Engineer in writing.

The tenderers are required to observe the website to find out if any correction slips issued subsequent to uploading of the Tender . Railway reserves the right to make any additions/alterations to the tender uploaded and issue corrigendum to the same effect. In case the tenderer fails to take note of the above corrigendum, the additions and alterations entered/effected in the corrigendum shall be binding upon the tenderer and no claim what so ever will be entertained by Railway.

Post tender clarification/correspondence shall be dealt as per GCC Works Clause 7E or if any.

These Conditions of tender shall be read in conjunction with General Condition of Contract /2022 subject to modification, additions or supersession's by Special Condition of Contract and Specification if any.
Contractor has also to submit execution programme within 15 days of issue of Acceptance letter or at the time of signing CA whichever is earlier.
The earnest Money deposited by the Contractor with his tender will be retained by the Railways as part of Security for the due and faithful fulfillment of the contract by the contractor. The balance to make up the security deposit, the rate of recovery should be @ 6 Percent of the bill amount till the full security Deposit of 5 Percent of the contract value is recovered. Any firm recognized by Department of Industrial Policy and Promotion (DIPP) as 'Startups' shall be exempted from payment of Bid Security detailed above. Labour Cooperative Societies shall submit only 50% of above Bid Security detailed above. The earnest Money and tender documents cost in respect of e-tendering will be accepted through net banking on payment gate way. The Bid Security shall be depositedeither in cash through e payment gateway or submitted as Bank Guarantee bond from a scheduled commercial bank of India or as mentioned in tender documents. The Bank Guarantee bond shall be as per Annexure-VIA and shall be valid for a period of 90days beyond the bid validity period.
Eligibility criteria for works tender in respect of Employment/Partnership etc. of Retired Railway Employees :-
- Should a tenderer
- be a retired Engineer of the gazetted rank or any other gazetted officer working before his retirement, whether in the executive or administrative capacity or whether holding a pensionable post or not, in the Engineering or any other department of any of the railways owned and administered by the President of India for the time being, OR
- being partnership firm / joint venture (JV) / registered society / registered trust etc have as one of its partners/members a retired Engineer of the gazetted rank or any other gazetted officer working before his retirement, OR
- being an incorporated company have any such retired Engineer of the gazetted rank or any other gazetted officer working before his retirement as one of its directors AND in case where such Engineer or officer had not retired from government service at least 1 year prior to the date of submission of the tender THEN the tenderer will give full information as to the date of retirement of such Engineer or gazetted officer from the said service and as to whether permission for taking such contract, or if the Contractor be a partnership firm or an incorporated company, to become a partner or director as the case may be, has been obtained by the tenderer or the Engineer or officer, as the case may be from the President of India or any officer, duly authorized by him in this behalf, shall be clearly stated in writing at the time of submitting the tender.
- In case, upon successful award of contract, should a tenderer depute for execution of the works under or to deal matters related with this contract, any retired Engineer of gazette rank or retired gazetted officer working before his retirement in the Engineering or any other department of any of the railways owned and administered by the President of India for the time being, and now in his employment, then the tenderer will ensure that retired Engineer or retired gazetted officer had retired from government service at least 1 year prior to the date of his employment with tenderer and in case he had retired from service within a year then he possesses the requisite permission from the President of India or any officer, duly authorized by him in this behalf, to get associated with the tenderer.
- Should a tenderer or Contractor being an individual, have member(s) of his family or in the case of partnership firm/ company / joint venture (JV) / registered society / registered trust etc. one or more of his partner(s)/shareholder(s) or member(s) of the family of partner(s)/shareholder(s) having share of more than 1%in the tendering entity employed in gazetted capacity in the Engineering or any other department of the railway, then the tenderer at the time of submission of tender, will inform the authority inviting tenders the details of such persons.

Every tenderer shall state in the tender his postal address fully and clearly. Any communication sent in time to the tenderer by post at the said address shall be deemed to have reached the tender duly and in time. Important documents shall be sent by Registered post.
Special Conditions
The work shall be carried out as per the direction of Sr. Divisional Electrical Engineer/TRD/LMG or his authorized representative.
The tender document as signed by the contractor shall be taken to mean as part and parcel of the agreement. The work order will be issued pending execution of the agreement.
Disposal of released parts The released materials will be reused as per requirement as decided by the consignee and balance if any shall be deposited to the Railway at consignee store.
Calendar Events Commencing of work within 15 days from the date of issue of letter of acceptance. To be completed within 12 months from the date of issue of Letter of acceptance of the tender. If contractor fails to complete the work within specified time, Liquidated damages may be imposed as per GCC.
This is purely a works contract like all other works contracts awarded by Indian Railways latest General Conditions of Contract 2022 with amendment time to time as applicable to this contract. Hence the contractor shall be entirely responsible for the employment of their labour and observe and be liable for statutory provisions of Govt. No claim of employment by the manpower engaged on the Railways on whatsoever ground shall be entertained.
The rates quoted shall be FIRM and shall include all statutory obligations on the part of the contractor.
This contract is of temporary nature. The Railways shall have discretion to change the scope of work contract as per the requirement and variation in the scope of work will be governed by GCC and shall not have any bearing on the rates quoted by the tenderer, which shall be treated as firm during the currency of the contract
The Railways representative shall have the authority to advise the contractor to remove or replace any workman/men whom he considers incompetent, unsuitable or harmful.
Contractor shall take due care and caution to avoid any damage to Railway property during the execution of the work, any damage / loss to Railway property due to negligent working of contractor shall be realized from the payment due to him.
Inspection of material to be carried out by RITES or representative of Sr.DEE/TRD/LMG only. All inspection charges will be borne by the contractor
Payment clause
- Twenty percent (20%) as restricted amount will be deducted from every on-account bill, which will be paid in the final bill.
- Payment towards supplied material should be restricted to 80% against receipt and acceptance by consignee and balance 20% payment should be paid in the final bill on successful commissioning.
- On Account payment up-to 80% will be paid in the total unit prices for single rate item for both supply and erection after successful erection/installation. (b) Balance 20% payment will be made through the final bill only after successful commissioning of the work of that particular station/section and handing over of the assets to the Railway duly tested and commissioned subject to compliance of the followings.
- On supply of Catalogue and operation manual/instruction books etc.
- On supply of as erected drawing of the equipment/installation.
- Issue of 'NO CLAIM CERTIFICATE' by contractor in favour of Railway. Payment for supply items included in the schedule of work and supplied as per conditions of the contract will be made for which All invoices shall be accompanied by the followings.
- Supplier's challan for supply of items.
- Inspection certificate of the authorized inspecting authority. (No payment will be made unless the inspection certificate has been submitted along with supplier's original challans or as mentioned elsewhere in the tender document).
- Certificate of current statutory taxes and duties.
- Detailed entries made in the Measurement Bookv)Certificate from authorized Dealer or OEM regarding procurement of material.
- Data of labour engaged uploaded in Shramik Kayan Portal with declaration as necessary
The contractor will maintain the said works for a period of 12.0 Calendar months from the certified date of their completion
Testing of tensile load strength of insulators must be done by contractor before putting them in service and to be certified by competent authority. Also testing date to be written on the cap of insulators.
If a tender is accepted on the quoted rates of bidder which is below the advertised tender value, an additional performance security shall be submitted by the bidder as below: If the bid is quoted between 0% and 5% below the advertised cost (inclusive), no additional performance guarantee is required; however, if the bid is quoted below 5% of the advertised cost, an additional performance guarantee of 5% shall be applicable.
Penalty Clause
- No work can be carried out without availability of site supervisor. If site supervisor is not available, then work will be stopped and penalty of Rs. 5,000/- per day per site will be imposed.
- All staff at site should wear all safety gears and follow all safety precaution to avoid any untoward incident. If staff is found without proper safety gear, then work will be stopped and penalty of Rs. 5,000/- per day per site will be imposed.
- If staff as per message of SSE/Office is not provided by Agency, then penalty of Rs. 5,000 per day per site will be imposed for delay in work on Agency. Moreover, in case the contractor fails to deploy sufficient personnel, and the erection work is carried out departmentally by Railway employees to avoid delay or ensure progress of the work, no payment shall be made to the contractor towards such erection items. Further, the applicable erection cost for such items shall be recovered from the contractor's bills as penalty.
- For any block burst, penalty will be imposed as per train detention cost analysis by operating department.
- Work will need to be done at multiple sites at same time. No excuse will be entertained by Administration regarding working at multiple sites. In case, staff is not provided by Agency for multiple sites, then penalty of Rs. 10,000/- per site per day will be imposed on the Agency.
- For any damage to Railway, recovery will be made as per cost of damage to Railway.
Indian Railways latest General Conditions of Contract 2022 and up to date corrections slips are applicable and binding on the contract.
It is necessary that the main contractor or his representative who is an employee of the contractor or a partner should be available at the site of work for day- to- day execution.
The rate includes supply erection and transportation of materials to different work site/stations by the contractor. No extra payment will be made in this regard. N.B: For items to be supplied by Railway, the same will be supplied from nearer depot in the division to the site by their own arrangement of the contractor. Tower wagon may be availed from railway administration only if available, for Contact wire replacement and OHE Adjustment and checking as when required for early execution of work with the approval of the competent authority.
The tenderer shall quote the rate by taking into account all the statutory duties/GST/taxes/cess/royalty etc. applicable to the work up to the date of opening of tender.
Any new impost or revision in the duties/GST/taxes/cess during the original currency of the contract will be to the Railway's account subject to production of Govt. Notification and documentary evidence. This will also be applicable for the work done during the extended period, if such extension is on Railways account.
However, if the extension of contract period is on account of failure of contractor, no compensation shall be made toward revision or imposition of any new taxes.
Any benefit on account of downward revision of duty/GST/taxes/cess either in original period or during the extended contract shall be passed on by the contractor to the Railways.
The contractor should get the measurement recorded in M.B. within 7 days of effective date of new impost or revision in the duties/taxes/cess to segregate the work done before change and after change. In the event of failure to do so, Railway's decision shall be final and conclusive.
The contractor shall have to upload labour details, every month in shramikkalyan portal.
Liability against risks/claims The contractor shall take out and keep in force a policy and policies of insurance against all liabilities and recognized risks in respect of accidents to persons employed by the contractor for the purpose of carrying out the works of this contract. In respect of all staff engaged by him the contractor shall be solely responsible against all claims under workmen's compensation Act. And labour contract Act. Etc. Any damage, deterioration, loss caused to Railway property due to negligence, carelessness on the part of the workmen employed by the contractor, shall be made good by the contractor at his own cost. If he fails to do this, Railways. Shall be within their rights to effect necessary recoveries from the contractor's bill through other means as per the law.
Staff deployed for work at various sites shall make their own arrangements for stay and transport. Railway is not responsible for such arrangement and necessary tools required for execution of the subject work are to be available with contractor & to be transported to work site timely by the vehicle arranged by contractor at his own cost.
Income Tax Recovery Being a Works Contract, income tax @ 2% of the contract value and surcharge on Income Tax and health and educational cess as applicable from time to time are recoverable from contractor's bills as per extant rule.
The contractor shall also employ qualified graduate engineer or qualified diploma engineer, based on values of contract, as may be prescribed by the ministry of Railways through separate instruction from time to time. In case the contractor fails to employ the engineer, he shall be liable to pay penalty at the rates, as may be prescribed by the ministry of railways through separate instructions from time to time for the default period for the provisions.
Railway has the right to close the contract at any time during the period of ongoing work.
No Bangadeshi, Rohingya or any other foreigner not entitled for this work as per Railway board's letter no. 2019/Sec(Int)/51/7/2-23 dtd 16.08.2021.
TESTING OF INSTALLATIONS After successful completion of the entire work/installation a certificate should be furnished by the contractor that the whole work has been carried out as per tender specification. The entire installations are to be tested as per the latest guideline. The details and data of testing of installations are to be recorded in a register duly signed jointly by the competent representative of contractor and consignee and to be kept at site camp office.
Methodology of work to be submitted by the tenderer within 15 days of issue of LOA.
Price Variation Clause (PVC) shall not be applicable to this work.
No TA/DA or any sort of other traveling facility will be provided to the contractor or to his authorized staff for undertaken Railway journey in connection with this contract
Erection All erection work will be subject to inspection by the purchaser or his representative to ensure that the work is done in acceptance with specification and approved drawing. After erection, supplier will have to give all performance tests as desired by purchaser
Contractor shall be liable to compensate the Railway administration for all damages and losses that may be caused to electrical (TRD) or other property belonging to the Railway Administration whether in his possession or not, through his negligence, misconduct, default or any other act of commission or omission or that of his agents, servants or employees.
Contractor has to keep their tools, instruments and equipment in their own custody at the space to be provided by railways. Theft or any unusual occurrence will be the full responsibility of the contractor
Railway reserves the right to demand for any particular make of fitting/equipment as mentioned in the list.
Transportation of materials by loading and unloading shall be arranged by contractor at his own cost, for supplied materials by contractor and materials supplied by railway for completion of work.
All the works are to be done in the presence of Railway representative.
The firm should paint CA No. and Date on each major executed items at a distinct spot

I /we also hereby agree to abide by the Indian Railways Standard General Condition of Contract-April 2022 with all correction slip up to date of closing of tender and to carry out the work according to the special conditions of contract and specification of materials and works as laid down by Railway in the attached special condition or specification, Schedule of rates with all correction slips up to date of closing of tender for the instant contract.

I/We the tenderer(s) also accept all the conditions of the tender and have signed all the pages in confirmation thereof.
I/we hereby declare that I/we have downloaded the tender documents from Indian Railway website www.ireps.gov.in . I/we have verified the content of the document from the website and there is no addition, no deletion or no alteration to the content of the tender document. In case of any discrepancy noticed at any stage i.e. evaluation of tenders, execution of work or final payment of the contract, the master copy available with the railway Administration shall be final and binding upon me/us.
I/we declare and certify that I/we have not made any misleading or false representation in the forms, statements and attachments in proof of the qualification requirements.
I/We also understand that my/our offer will be evaluated based on the documents/credentials submitted along with the offer and same shall be binding upon me/us.
I/We declare that the information and documents submitted along with the tender by me/us are correct and I/we are fully responsible for the correctness of the information and documents, submitted by us.
I/we certify that I/we the tenderer(s) is/are not blacklisted or debarred by Railways or any other Ministry / Department of Govt. of India from participation in tender on the date of submission of bids, either in individual capacity or as a HUF/ member of the partnership firm/LLP/JV/Society/Trust.
I/we understand that if the contents of the certificate submitted by us are found to be forged/false at any time during process for evaluation of tenders, it shall lead to forfeiture of the Bid Security and may also lead to any other action provided in the contract including banning of business for a period of upto two year. Further, I/we and all my/our constituents understand that my/our offer shall be summarily rejected.
I/we also understand that if the contents of the certificate submitted by us are found to be false/forged at any time after the award of the contract, it will lead to termination of the contract, along with forfeiture of Bid Security/Security Deposit and Performance guarantee and may also lead to any other action provided in the contract including banning of business for a period of upto two year.
I/We have read the clause regarding restriction on procurement from a bidder of a country which shares a land border with India and certify that I am/We are not from such a country or, if from such a country, have been registered with the competent Authority. I/We hereby certify that I/we fulfil all the requirements in this regard and am/are eligible to be considered (evidence of valid registration by the competent authority is enclosed)
