Railways reserve the right to procure the bulk / full quantity from Only OEM or their authorized dealer as per clause no.16.5 of Eastern Railways Stores General Tender Conditions. Authorized dealer must upload valid tender authorization of OEM, otherwise offer will be summarily rejected.

In terms of Railway Board letter no. 2015/RS(G)/779/5(Vol.III) dated 22.06.2020 and in keeping with the Public Procurement (Preference to Make in India) Order 2017 as amended time to time, it has been found that there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore, public procurement of this tendered item is restricted to Class-I local suppliers only (Class-I local supplier means a supplier having local content equal to or more than 50 Percent).The vendors who do not qualify to be Class-I local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class- I local supplier for the tendered item, participates in the tender, it does so at its own risk and cost and Railway shall not be liable for any loss or damage caused to the vendors.

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

The purchaser shall be entitled to increase the order quantity by 30% anytime within the delivery period (including extended delivery period) on the same terms and conditions. The increase in quantity with respect to the tender quantity can be done even at the time of ordering and the tenderer shall be bound to accept the quantity so ordered on the basis of his original offer. The purchaser shall be entitled to exercise (+) 30% option clause in one or more than one installment as long as the total variation in quantity does not exceed the limit of 30% of ordered quantity.

The contract shall be governed by latest version (along with all correction slips) of IRS Conditions of Contract, Eastern Railway General tender condition of Stores Department and all other terms and conditions incorporated in the tender documents.

Inspection by Third Party is applicable. No deviation in inspection is acceptable Tenderer to refer Clause 7.0 of ER General Tender Condition.

Guarantee/Warranty shall be as specified in relevant specification .Wherever this clause is not covered in the specification, IRS guarantee/warranty clause will apply.

1. Earnest Money Deposit and Security Deposit money shall be applicable as per clause 8 and 9 of Instruction to Tenderers Section-1 of General Tender Conditions.
2. Bidders availing exemption from submission of EMD has to submit Bid security declaration along with their bid.

Price Variation Clause is not applicable in this tender. Offer with PVC as a condition will be summarily rejected. Please refer to Clause 4.0 of Section -2 of General Tender Conditions for details.
