Special Eligibility Criteria

• i.) Railway reserves the right to order either the entire or the bulk quantity on the RDSO Item ID: 3100272, , Approved vendor or their dealer only. Status of approval of tenderer shall be reckoned as on the date of tender opening and not thereafter, unless it is a case of downgrading/ removal/suspension/ banning. ii.) Vendors approved for developmental ordering shall be eligible for developmental order of up to 20% of Net Procurable Quantity [NPQ]. iii) Authorized dealers/ distributors need to quote with tender specific authorization from the approved vendors/developmental vendors/Manufacturers failing which offer will be summarily rejected. While issuing such authorizations the approved vendors must ensure that these authorized dealers/distributors are in a position to raise inspection requests on the online portal of inspecting agencies viz. RITES, RDSO as the case may be.

Payment Terms

• 100% payment will be made after receipt, inspection and acceptance of the material by the consignee at destination.

Statutory Variation Clause

• Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

• The Contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents. In case of any conflict between the IRS conditions and Tendered terms and conditions, tendered terms and conditions shall prevail.

Commercial-Compliance

• In keeping with the Public Procurement (Preference to Make in India) Order, 2017 as amended and in terms of clause 2.4.5 of Instructions to tenderers for e- Tender, NR ITT_Rev_1.21_April_2024 and its applicable Correction_slips. Public Procurement of this item is restricted to Class-I and Class -II local suppliers only. Bidders are required to indicate the Local Content in their offered product in the requisite field in the offer form.

• 1. In terms of clause 4.0 of the Instructions to Tenderers for E.tenders, NR ITT_Rev_1.21_April_2024 and its applicable correction_slips , Bidders not failing in the exempt category for furnishing EMD, are required to Mandatorily furnish the requisite EMD along with their offer, Failing which their offer will be summarily rejected.
  2. In terms of Clause 12.0 for E . t e n d e r s , ITT_Rev_1.21_April_2024 and its applicable Correction_slips successful bidders unless failing in the exempt category for submission of S.D. are mandatorily required to submit Security Deposit at 5% of the value of Contact value.

• Bidders are required to submit a duly signed certificate as per clause 2.4.3 o f NR ITT_Rev_1.21_April_2024 and its applicable Correction_slips for compliance to the conditions regarding restrictions on procurement from bidders from countries sharing land borders with India. The format of certificate is mentioned below for ready reference of bidders. I have read the clause regarding restrictions on procurement from a bidder of a country which shares a land border with India;

  1. I certify that I am not from such a country; or
  2. I am from such a country and have been registered with the competent Authority. I hereby certify that I fulfil all the requirements in this regard and eligible to be considered. Evidence of valid registration by the competent authority is attached. NOTE1: Bidder is requested to please Strike out clause(a) or clause(b) whichever is not applicable to bidder while submitting above duly signed certificate. NOTE2. Bidders , who are not from such a country which shares land Border with India, should select YES in the Complied column. However, in case, the bidder is from a country sharing land border with India, should select NO in the complied column.

• The tenderers in their bids shall indicate the details of their jurisdictional assessing officers (Designation, address & email ID). Also tenderers are required to furnish the correct HSN code for the offered item along with their bid.

General Instructions

• Bank Account details for the purpose of payment shall be taken as appearing in the profile of the vendor in IREPS. In case, there is any change in the bank account details, vendors are advised to update their bank account details in their IREPS profile.
