Statutory Variation Clause

  • Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

  • IRS Conditions of Contract The contract shall be governed by latest version (along with all correction slips) of IRS conditions of contract as on tender closing date, conditions stipulated in Instructions to Tenderer for Electronic Tenders invited on IREPS Revision ITT_Rev_1.21 of April-2024 (along with all correction slips) or latest as on tender closing date and all other terms and conditions incorporated in the tender documents. Instructions to Tenderers for Electronic Tenders Revision ITT_Rev_1.21 of April- 2024 along with all correction slips or latest version have been uploaded on IREPS website ireps.gov.in

Commercial-Compliance

  • The bidder while submitting their bids shall give the following declaration: " We agree to pass on such additional setoff/input tax credit as may become available in future under the GST provision in respect of all inputs used in the manufacturer of the tendered item on the date of supply, by way of reduction in price and advised the purchaser accordingly".

Special Conditions

    1. All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law.
    2. EMD/SD-As per INSTRUCTIONS TO TENDERERS FOR ELECTRONIC TENDERS Issued by: PCMM, Northern Railway, Baroda House or latest as on tender closing date is applicable.
    3. Tenderers seeking exemption from payment of EMD (Earnest Money Deposit ) must upload requisite documentary evidence in support of their claim.
    4. Contracts valuing above Rs. 1 Lakh, Pre- inspection of material by third party will be accepted as per DY.CMM/IC Northern Railway L/No 29-S/03/Genl.Instructions/NR/SPS Dated 27-09-2023 and contract valuing below Rs 1 Lakh inspection by consignee may be considered.
