Special Eligibility Criteria

1. Railway reserves the right to procure entire or bulk quantity from ICF approved source (that is ICF ID 2300040) as per clause 16.3 of Eastern Railway General Tender Condition.
2. Make in India :- Applicable as per Clause No. 28.0 of Eastern Railway General Tender Condition.
3. The Railway reserves the right to order bulk quantity (80% or more of Net Procurable quantity) on the approved sources, and the offers of developmental sources may be considered only for developmental order of small quantity up to 20% only if the offers are competitive."Developmental Vendors" are only such vendors which are listed as developmental vendors on UVAM without any condition. The status of approval of tenderer shall be reckoned as on the date of tender opening and not thereafter, unless it is a case of downgrading/ removal/ suspension/ banning.
4. The subject item has been categorized under 3 (a) as per Public Procurement (Preference to Make in India) Order No. P- 45021/2/2017-PP (BE-II) dated 16.09.2020 issued by DPIIT, Ministry of Commerce and Industry, as there is sufficient local capacity and competition in supply of the tendered item of required quality and therefore public procurement of the item is restricted to Class-I local suppliers only (having local content equal to or more than 50% as defined under the Para 2 of the above order) and the vendor, who do not quality to be class I local suppliers, is not allowed to bid in this tender and their offer shall not be considered for any ordering. In case any vendor, who does not qualify to be class-I local supplier for the tendered item, but participates in the tender, it does so at its own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor.

Statutory Variation Clause

Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

1. General Conditions of Contract: The contract shall be governed by latest version [along with all correction slips] of General Conditions of Contract, and all other terms and conditions incorporated in the tender documents.
2. IRS Conditions of Contract: The Contract shall be governed by latest version [along with all correction slips] of IRS conditions of contract, and all other terms and conditions incorporated in the tender documents.

Commercial-Compliance

Delivery Place Firm to ensue the delivery at respective depots. Offer without delivery to a particular consignee as desired in the tender shall be treated as invalid offer for that consignee.
1. Special conditions of Contract for Handling of Rejection of pre- inspected item and warranty rejections as per Clause 7.1 of GST of Eastern Railway is applicable.
2. Force Majeure Clause as per Clause 11.0 of GST of Eastern Railway is applicable.
Marking Manufacturer's name month & Year of manufacturing should be indicated on the material or the packing of the material as per specification or feasibility as the case may be.
Guaranty/Warranty As per Drawing/specification. In case specification does not specify guarantee/warranty clause then the same should be as per IRS Conditions of Contract i.e. 30 months from the date of supply.
Confirmation You have gone through the Tender Documents consisting of Instructions to Tenderers, General Tender Conditions and Special Conditions of Tender, and you are agreed and confirm to abide by the Instructions to Tenderers, General Tender Conditions, IRS Conditions of Contract and the Special Conditions of Tender.

GST
1. It shall be the responsibility of the Bidders to quote correct HSN Number and corresponding GST Rate,
2. The offer shall be evaluated based on the GST rate quoted by each bidder and same will be used for determining the inter-se- ranking. While submitting offer, it shall be the responsibility of the Bidder to ensure that they quote correct GST rate and HSN number,
3. Purchaser shall not be responsible for any misclassification of HSN number or incorrect GST rate if quoted by the bidder,
4. Wherever the successful bidder invoices the goods at GST rate or HSN number which is different from that incorporated in the Purchase Order, payment shall be made as per GST rate which is lower of the GST rate incorporated in the purchase order or billed,
5. Vendor is informed that she/he would be required to adjust her/his basic price to the extent required by higher tax billed as per invoice to match the all inclusive price as mentioned in the purchase order,
6. Any amendment to GST rate or HSN number in the contract shall be as per the contractual conditions and statutory amendments in the quoted GST rate and HSN number, under SVC.

Special Conditions

Liquidate damage Recovery of Liquidated Damage(LD) on delayed supply : Recovery of Liquidated Damage(LD) on delayed supply will cover from the vendor/contractor, as agreed, Liquidated Damages(LD) and not by way of penalty, a sum equivalent to @1/2%(half percent) of the price of any stores(including elements of GST freight etc) which the contractor has failed to deliver within the period fixed for delivery in the contract or as extended for each week or part of a week during which delivery of such stores may be in arrears where delivery thereof is accepted after expiry of the aforesaid period subject to maximum of 10%(ten percent) of total value of the delayed supplies as per clause no.14.0 of General Tender conditions shall be applicable.
Deviations Deviation if any should be mentioned in the deviation tab of the offer. Deviations if mentioned in uploaded documents will not be considered.
Tender Governing condition Contract will be governed by IRS Condition of Contract, ER General Tender Condition and any other Terms and Condition mentioned in Drawing and Specification.
EMD and SD As per Clause No. 8.0 and 9.0 of Instructions to Tenderers of Eastern Railway.
