Design, Supply, Erection, Testing, commissioning of Laying of Cable for the connection of SP/SSP/ in NDLS-CPYZ Section of Delhi Division of Northern Railway for raising of speed to 160 Kmph

2.2.2.2Financial Capacity: The Bidder shall have a minimum Net Worth[ Net worth has been adopted as the criterion for assessing financial capacity since it is a comprehensive indication of the financial strength of the Applicant.] (the "Financial Capacity") of Rs. 4.71 crore at the close of the preceding Financial Year . The tenderer shall not have total amount of dispute in their pending litigation more than Fifty percent (50%) of the tenderer's Net Worth. The tenderer shall be examined for all pending litigation from all contracts completed or all ongoing contracts. The tenderer shall provide detailed information of all such pending litigations in the prescribed proforma given in Appendix-VIII. The details of all pending litigation shall comprise of all such Arbitration cases and also all pending Court cases irrespective of whether these litigations have been initiated by the tenderer against their Employer/Authority/Client or by the Client/Employer/Authority against the tenderer. The amount of disputes shall also comprise of all the claim amount and also all counter-claim amount in such Arbitration/Court cases. (Amendment No. 3; 09.07.26)

Technical Capacity (Complete details given in RFP document)- For demonstrating Technical Capacity and experience (the "Technical Capacity"), the Bidder shall during the last 5 ( five) previous -financial Years and the current financial year upto the Base month (not to be read with para-2.1.13).

1. have received payments for construction of Eligible Project(s), or has undertaken construction works by itself in a PPP project, such that the sum total there of, as further adjusted in accordance with clause 2.2.2.4 (i) &
2. is more than 2.5 (two and half) times the Estimated Project Cost (the "Threshold Technical Capacity"). Provided that at least one fourth of the Threshold Technical Capacity shall be from the Eligible Projects in Category 1 and/ or Category 3 specified in Clause 2.2.2.4 (i) & (ii) (ii)Completed (executed) or Substantially completed$ (executed) at least one Eligible Project of Railway Sector as mentioned in clause 2.2.2.4/iii of value of not less than 35% (thirty-five) per cent of the Estimated Project Cost. and However, in case of Consortium/Joint Venture, the other members of Consortium/Joint Venture (who are not considered for satisfying this technical Capacity under this clause) also must have Completed (Executed) or Substantially completed$ at least one Eligible Project of Railway Sector as mentioned in clause 2.2.2.4/iii of value of not less than [10% (ten) per cent] of the Estimated Project Cost

3.1.6 Tests of responsiveness-As a first step towards evaluation of Technical Bids, the Authority shall determine whether each Technical Bid is responsive to the requirements of this RFP. A Technical Bid shall be considered responsive only if:

1. The Bid is received online as per the format at Appendix-IA including Annexure I, II, III, IV, V, VI, Appendix-IB, Appendix-IC for Contractor's Work Plan and Appendix-VII (if applicable); (Amendment No. 2; 13.03.26) (Amendment No. 4; 31.08.26)
2. All Documents listed at clause 2.11.2 are received physically within time as mentioned in clause 1.3;
3. Technical Bid is accompanied by the Bid Security as specified in Clause 1.2.4 and 2.20;
4. The Power of Attorney is uploaded on e- procurement portal as specified in Clauses 2.1.5;
5. Technical Bid is accompanied by Power of Attorney for Lead Member of Consortium /Joint Venture and the Joint Bidding Agreement as specified in Clause 2.1.6, if so required;
6. Technical Bid contains all the information (complete in all respects);
7. Technical Bid does not contain any condition or qualification;

A Bidder is required to submit, along with its Bid, a Bid Security of Rs.1,88,31,900/- (the "Bid Security"), refundable not later than 200 (Two hundred) days from the Bid Due Date, except in the case of the Selected Bidder whose Bid Security shall be retained till it has provided a Performance Security and Additional Performance Security (if any) as per the provision of this RFP and LOA. The Bidder will have to provide Bid Security through [Account Payee Demand Draft, Fixed Deposit Receipt, Banker's Cheque, e- payment Gateway of Authority or submitted as Bank Guarantee Bond from a scheduled commercial bank of India]. The Bank Guarantee bond shall be as per Appendix-VII and shall be valid for a period of 90 days beyond the bid validity period. The Bid shall be summarily rejected if it is not accompanied by the prescribed amount of Bid Security. The Bid document shall be available free of cost through e-portal (IREPS.gov.in).
