    6. DRUG ANALYSIS REPORT FOR EACH BATCH FROM MANUFACTURERS OWN LABORATORY/GOVT. RECOGNIZED LABORATORY SHOULD BE SENT ALONG WITH THE SUPPLY FOR ACCEPTANCE OF DRUGS MEDICINE.
    7. THE RAILWAY ADMINISTRATION RESERVES THE RIGHT TO TAKE SAMPLE OF ITEM FROM SUPPLIED PRODUCT FOR ANALYSIS. THE MATERIAL MAY BE SUBJECT TO TESTS IN RAILWAY/GOVT./GOVT. RECOGNIZED LABORATORY ON RANDOM BASIS OR WHENEVER FOUND NECESSARY BY THE CONCERNED CONSIGNEE. THE COST OF THE ANALYSIS WILL BE BORN BY THE SUPPLIERS IN CASE OF UNSATISFACTORY REPORTS .WHENEVER DRUGS SAMPLES ON ANALYSIS ARE FOUND NOT CONFIRMING TO STANDARD SPECIFICATION , THE SUPPLIER ARE REQUIRED TO REPLACE THE WHOLE QUANTITY FREE OF COST. IRRESPECTIVE OF WHETHER THE BATCH HAS BEEN USED COMPLETELY/PARTIALLY OR NOT.
    8. MEDICINES SHOULD BE MANUFACTURED BY THE FIRM THEMSELVES WHICH MUST BE MENTIONED IN LABELLING/PACKING. IF THE PRINCIPAL FIRM IS MARKETING THE MEDICINE MANUFACTURED BY OTHER FIRM THE NAME OF PRINCIPAL FIRM MUST BE ENDORSED ON THE PACKING OF THE PRODUCT.
    9. THE PACKING OFFERED SHOULD BE SUCH AS TO WITHSTAND ROUGH HANDING, TRANSPORTATION AND EXPOSURE TO EXTREME TEMPERATURE AND CLIMATIC CONDITION.
    10. THE PRODUCT/MEDICINE /DRUGS REQUIRED IN PROPER SAFE PACKING AND IN LOOSE PACKING WILL NOT BE ACCEPTED.
    11. THE SUPPLIER MUST MENTION THE BANK ACCOUNT NUMBER, IFSC CODE, ALONG WITH NAME OF BRANCH OF THE O S S BANK IN OFFER AS WELL AS IN THE BILL.
    12. DRUGS/PRODUCTS OF HUMAN ORIGIN SHOULD ALSO HAVE A CERTIFICATION STATING: FREE FROM HIV, HEPATITIS B AND HEPATITIS C AND E, ANTI HAEMOLYTIC FACTORS IMMUNOGLOBULIN, HUMAN ALBUMIN ETC.
    13. ALL REJECTED ARTICLES MUST BE REMOVED BY THE SUPPLIERS AT THEIR OWN RISK AND COST WITHIN 14 DAYS OF REJECTION NOTICE. IF THE REJECTED MATERIAL IS NOT REMOVED WITHIN THE SPECIFIED PERIOD, THE RAILWAY SHALL AT LIBERTY TO RETURN THE MATERIAL IS ON FREIGHT PAID BASIS TO THE FIRM AND FREIGHT PAID BY RLY. WILL BE RETURNED FOR FIRM WITHOUT ANY FURTHER REFERENCE. IF IN OPINION OF THE INSPECTING OFFICERS, THE MATERIAL IS NOT WORTH RETURNING THE SAME SHALL BE THROWN AWAY OR DESTROYED. NO CLAIM OF COST AND COMPENSATION WILL BE ENTERTAINED AGAINST THESE ITEMS.

Statutory Variation Clause

  • Statutory Variation in taxes and duties, or fresh imposition of taxes and duties by State/ Central Governments in respect of the items stipulated in the contract (and not the raw materials thereof), within the original delivery period stipulated in the contract, or last unconditionally extended delivery period shall be to Railways' account. Only such variation shall be admissible which takes place after the submission of bid. No claim on account of statutory variation in respect of existing tax/duty will be accepted unless the tenderer has clearly indicated in his offer the rate of tax/duty considered in his quoted rate. No claim on account of statutory variation shall be admissible on account of misclassification by the supplier/ contractor.

Standard Governing Conditions

  • The tender/contract shall be governed by latest version (along with all correction slips) of IRS Conditions of Contract, all other terms and conditions incorporated in the Tender Document, terms and conditions incorporated in the documents uploaded with the Tender Document and Bid Document Ver. 26 along with CS. In case of any contradiction in the terms and conditions, the order of precedence shall be the Tender Document, followed by the Special Conditions of Tender if any uploaded with Tender Document, followed by the related Specification/Drawing mentioned in/attached with Tender Document, followed by the Bid Document Ver. 26 along with CS, followed by latest version (along with all correction slips) of IRS Conditions of Contract. NO CONFIRMATION FROM THE DISTRIBUTOR/SUPPLIER IS NECESSARY IN THESE CASES.15) PRICE VARIATION CLAUSE WILL NOT BE ACCEPTABLE.16)INPUT TAX CREDIT: IN CASE YOU AVAIL ITC AGAINST GST & CORRESPONDING ADDITIONAL BENEFITS ON THIS ACCOUNT, IF ANY TO BE PASSED ON TO PURCHASER.17) WHENEVER DRUG SAMPLES ON ANALYSIS ARE FOUND TO BE NOT CONFORMING TO STANDARDS, THE FIRMS/ SUPPLIERS ARE REQUIRED TO REPLACE THE WHOLE BATCH FREE OF COST WITH ANOTHER BATCH TO THE CONSIGNEES, IRRESPECTIVE OF WHETHER THE BATCH HAS BEEN USED COMPLETELY/ PARTIALLY OF NOT.18) LIQUIDATED DAMAGE (LD) ON DELAYED SUPPLY: RECOVERY OF LIQUIDATED DAMAGE (LD) SHALL BE LEVIED @1/2% (HALF PERCENT) OF THE PRICE OF THE DELAYED STORE PER WEEK OR PART OF THE WEEK DURING WHICH DELIVERY IS ACCEPTED AND THE UPPER LIMIT FOR RECOVERY OF LD IN SUPPLY CONTRACTS IS 10% (TEN PERCENT) OF THE VALUE OF CONTRACT IRRESPECTIVE OF DELAYS, UNLESS OTHERWISE PROVIDED, SPECIFICALLY IN THE CONTRACT.
