Statutory Variation Clause

Any changes in GST due to changes shall be allowed during the original delivery period against documentary evidences. However, same will not be allowed due to increase in turnover or misclassification.

The contract shall be governed by IRS condition of contract latest version, SECR General Tender Condition 2019 (along with all correction slips and all other terms and conditions incorporated in tender documents attached with this tender

Commercial-Compliance

FOR Destination. Firm are advised to quote with delivery term FOR Destination. If firm will offer with delivery term FOR ex-Works and delivery by Road/Rail then firm shall dispatch the stores in such a way that it shall reach the ultimate consignee before terminal date of delivery mentioned in the contract. In such cases merely the dispatch of material within contractual delivery period does not mean that the firm has supplied the material within contractual delivery period but it shall reach to ultimate consignee on or before contractual delivery period as date of supply of material.
1. Purchase Preference to MSEs:- Micro and Small Enterprises firms registered with DICs/KVIC/KVI Board/Coir Board/NSIC/Directorate of Handicraft and Handloom /Any other body specified by Ministry of MSME may please refer the attached documents. Such firms who are interested in availing themselves of these benefits will enclose with their offer the proof of the fact that they are registered for tendered item with any of these agencies as mentioned in the notification no.503 dated-23-03-2012, as printed in the Gazette of India. MSE firm shall upload there MSE certificate along with offer to get the price preference available to MSEs. In absence of same if the case is decided by considering firm as non MSE firm, the onus or responsibility will be of firm.
2. If you are not a MSE or a consortia of MSEs formed by NSIC, please indicate percentage of sub contracts in execution of this tender that will be from Micro and Small Enterprise (in percent of order value) with further breakup of MSE owned by SC/ST. (Information will be provided in % terms with 6 fields; Micro owned by SC, Micro owned by ST, Micro owned by Others, Small industry owned by SC, Small industry owned by ST, Small industry owned by Others) .

Special Conditions

All the bidders/tenderers should ensure that they are GST compliant and their quoted tax structure/rates are as per GST Law

Consequence of Failure
1. In case firm fails to execute the contract within original or extended delivery period, the purchaser will be entitled to impose Liquidated Damages(LD) for extension of Delivery Period or may decide to cancel the contract by forfeiting the Security Deposit submitted by the firm.
2. In case where SD has been exempted for any reason, and the supplier fails to supply goods as per the conditions of the contract, as amended from time to time, Purchaser shall have right to levy damages from the supplier for failing to comply with contractual conditions not by way of penalty, an amount equal to SD amount, as would have been applicable if the contract was with a non -exempted vendor. These damages shall be treated as outstanding recoveries against the vendor and dealt accordingly.
If vendor quotes delivery period as range bound period then the lower value of that range will be considered for delivery period.
TP CLAUSE Time Preference order: In cases where it is decided to accept a higher price than the lowest tender consideration /interest of earlier delivery ,passing over the lowest acceptable offer ,following condition will apply: It should be noted that if a contract is placed on a higher tenderer as a result of this invitation of this tender, in preference to the lowest acceptable offer in consideration of offer of earlier delivery, the contractor will be liable to pay the government the difference between the contract rate & that of the lowest acceptable tenderer on the basis of final price FOR destination including all element of fright ,sales tax ,local taxes ,duties & other incidentals in case of failure to complete supplies in terms of such contract within the date of delivery specified in the tender & incorporated in the contract .This is in addition & without prejudice to other rights under the terms of contract. Delivery period is important criteria to decide the Tender being Emergency purchase
