I have read the clause Sr. No. 32 of Instructions to tenderers and general conditions of tenders for supply contract attached with the tender regarding restrictions on procurement from a bidder of a country which shares a land border with India or bidder who has a specified Transfer of Technology (T.O.T) arrangement with an entity from a country which shares a land border with India and on sub- contracting to contractors from such countries.
2. I certify that this bidder is neither from such a country nor have a specified Transfer of Technology (T.O.T) arrangement with such an entity from a country which shares a land border with India and will not sub- contract any work to a contractor from such countries unless such contractor is registered with the Competent Authority. Special Eligibility Criteria

Bulk quantity order will be placed only on tenderers with satisfactory past performance for Bearing piece assembly with locking arrangement for Single piece uncoupling gear. as per Para 2.6 of GCC. The firm may read the Para 2.6 of GCC for full details . Authorized dealers must upload tender specific authorization from their OEM, otherwise offer will be summarily rejected without any back reference.

The procurement of the item is restricted to Class I local suppliers only and the vendors who do not qualify to be Class I local suppliers should not quote in the tender as their offers shall not be considered for any ordering. In case any vendor who does not qualify to be a Class I local supplier for the tendered item and participates in the tender it does so at their own risk and cost and Railways shall not be liable for any loss or damage caused to the vendor. Requirement of a vendor to be a Class-I local supplier for this item, shall be a mandatory condition in addition to other qualifying eligibility criteria/conditions. Commercial-Compliance

1) Earnest Money and Security Deposit are applicable as per para 5 and 6 of GCC attached with this Tender. Tenderer to read these clauses carefully,
1. Vendors appearing on the approved vendor lists of RDSO/PUs/CORE are exempted from the EMD/SD payment. However, dealer/authorized agent of RDSO/PUs/CORE vendors, who participate against authorization of such approved vendor of RDSO/PUs/CORE are not exempted from the submission of the EMD/SD.
2. However, approved sources directly participating in the tender and stipulating in IREPS that the order be placed on authorized dealer are to be considered as exempted from the EMD/SD payment.

Special Conditions

As time is the essence of contract, the tenderers are to note the Railways required delivery schedule given in the tender schedule and quote accordingly. Vague delivery period or a very high delivery period compared to Railways specific delivery period in the tender schedule may be considered commercially unresponsive and is liable to be ignored.
Warranty/Guarantee Clause As per IRS conditions of contract.
Validity of offer must be for minimum 120 days.
Firm should indicate appropriate HSN code of the offer item.

Undertakings

1. We hereby declare that in quoting the above price, we have taken into account the full effect of Input Tax Credit available under GST. We further agree to pass on any financial gain/benefit as may become available in future in respect of all the input tax credit on the date of supply by way of reduction in price and advise the purchaser accordingly. We also undertake that we are aware of the provisions of section 171 of the CGST Act and consequences thereof if we fail to comply with the same.
2. We shall file GSTR-1 and GSTR-3B for transaction with Railways in due time preferably every month so that ITC benefit can be availed by Railway.
