OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidders shall quote only those products (Part of Service delivery) in the bid which are not obsolete in the market and has at least 1 years residual market life i.e. the offered product shall not be declared end-of- life by the OEM before this period.

Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any responsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is lower), subject to the maximum of quoted GST %.

Scope of supply (Bid price to include all cost components) : Supply Installation Testing and Commissioning of Goods

Availability of Service Centres: Bidder/OEM must have a Functional Service Centre in the State of each Consignee's Location in case of carry-in warranty. (Not applicable in case of goods having on-site warranty). If service center is not already there at the time of bidding, successful bidder / OEM shall have to establish one within 30 days of award of contract. Payment shall be released only after submission of documentary evidence of having Functional Service Centre.

Escalation Matrix For Service Support : Bidder/OEM must provide Escalation Matrix of Telephone Numbers for Service Support.

NET WORTH: Net Worth of the OEM should be positive as per the last audited financial statement.

Buyer Added text based ATC clauses

• 1.The successful bidder is required to deliver items to the locations as specified in the attached Specification document.
• 2.Bidders must upload actual pictures of the items they are providing. Those bidders who have no t upload the pictures of the items will result in rejection the bid.
• 3.An interaction with the bidders will be held to address queries and provide necessary instruction s related to the bid process.
• 4.Items to be procured will be segregated as per the specification document enclosed with the bid properly packed so that no item will be damage while transporting it to specified locations.
• 5.In case any damage occurs during the transportation the sole responsibility will be of the bidder. Accordingly the deductions (Cost) of the damaged items will be imposed while processing t he payment on GEM.
• 6.All products should be of good quality and meet high standards.
• 7.Bidders are required to provide consent as mentioned in the Buyer Added Bid Specific ATC, conf irming their agreement to supply items as per the list attached therein.
• 8.Equivalent products and brand neutrality. Any brand names appearing in the item descript ion are indicative only and are intended to describe the required quality/functional standard, unles s the procurement is specifically approved as a proprietary/PAC procurement. Equivalent products of any make may be offered if they meet or exceed the stated technical specifications and applica ble standards. No bidder shall be rejected solely because the offered equivalent product is of a diff erent brand.
• 9.Quality, packing and delivery. The quoted price shall include all applicable costs for packing, transport, freight, unloading and delivery to the consignee locations specified in the bid. Items shal l be new, unused, genuine and free from defects; they shall be packed to prevent damage during t ransit. Delivery shall be completed within the period stated against each item/consignee in the Ge M bid. The bidder shall not substitute an item or reduce pack quantity without prior written approv al of the Buyer.
• 10.Inspection, acceptance and damaged/defective goods. The consignee/authorised officer shall verify the quantity, pack size, visible condition and conformity with the published specificatio ns at delivery. Short-supplied, damaged, expired (where shelf life applies), defective or non-confor ming goods shall be replaced by the supplier at no additional cost within 7 calendar days of writte n intimation, or within another period approved by the Buyer. Payment/acceptance shall be proces sed in accordance with GeM procedures and the contract. Any recovery shall be based on docume nted shortage, damage or non-conformity and the applicable contract terms; no arbitrary deductio n shall be made.
• 11.Paper specification. Copier paper shall be of the size and quality specified item-wise in the B OQ. Where the requirement is A4/legal copier paper, each ream shall contain at least 500 sheets a nd have a minimum grammage of 75 GSM, if this requirement is confirmed by the indenting autho rity. The bidder shall state the offered paper’s GSM, sheet count and pack details in its technical o ffer. Applicable GeM category specifications and mandatory standards shall be followed.
• 12.Cleaning, hygiene and chemical products . Cleaning and hygiene products shall be supplie d in sealed, labelled original packs with manufacturer/importer details, net quantity, batch number and manufacturing/expiry dates wherever applicable. Products shall have adequate remaining she lf life at delivery. The Buyer may reject leaking, tampered, expired or unlabelled packs in accordan ce with the published specifications.
• 13.Warranty and service support. Warranty, service-centre, helpline and escalation-matrix req uirements shall apply only to items for which such support is relevant and specified in the applica ble GeM category or item specification (for example, electrical/electronic equipment). These requir ements shall not be applied indiscriminately to stationery, paper or routine consumables.
• 14.Applicable taxes and invoicing. The bidder shall quote prices and GST details in the manne r required by GeM. GST and invoicing shall be handled in accordance with applicable law, the GeM contract and the price quoted. The supplier shall submit the invoice and delivery/acceptance docu ments required for payment.
• 15.Quantity variation / option clause . Any increase or decrease in quantity shall be governed by the option clause and limits available in the published GeM bid and applicable GeM GTC. No var iation beyond those limits shall be presumed or imposed through this ATC.
• 16.Make in India and purchase preference . Make in India purchase preference shall be applie d in accordance with the applicable DPIIT order and amendments, the local-content thresholds con figured in GeM, and the bid’s purchase-preference settings. Required local-content declarations/ce rtificates shall be furnished in the form and at the stage required by the applicable rules. No prefer ence shall be granted solely on the basis of a bidder’s office location.
• 17.MSE Purchase Preference: MSE purchase preference shall be governed by the applicable Pu blic Procurement Policy for Micro and Small Enterprises (MSEs) and the prevailing GeM rules. The bidder must fulfil the eligibility criteria applicable to the product category, including any OEM/man ufacturer requirements, wherever prescribed. The Buyer shall verify the bidder’s online registratio n and supporting documentary evidence before extending any applicable benefits. Bidders claimin g MSE benefits shall upload a valid MSME registration certificate/document applicable for the Financial Year 2026–27.
• 18.Evaluation and award. Evaluation shall be conducted strictly according to the evaluation me thod and item/lot structure configured in GeM. The Buyer should, before publication, consider sep arate category-wise bids/lots for materially different groups of goods where permitted by GeM, rat her than combining unrelated products into a single total-value basket. Any lot-wise evaluation or bid splitting must be enabled and described in the GeM bid itself; this ATC alone shall not change t he system evaluation method.
• 19.Clarifications and equal treatment. Any clarification sought during evaluation shall be sou ght through the GeM workflow and handled consistently for similarly placed bidders. No material c hange to specifications, eligibility conditions or evaluation criteria shall be introduced after bid clos ing except as permitted by applicable rules and the GeM process.
• 20.Compliance and precedence. These ATC clauses shall be read with the GeM bid, GeM GTC, r elevant category specifications and applicable Government procurement policies. If any clause co nflicts with mandatory GeM provisions or applicable Government orders, the mandatory provisions shall prevail and the bid shall be corrected before publication. .
