OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

• 1.1 The contract covers the supply and delivery of Electrical & Mechanical (E/M) Items (including LED li ghts, tube lights, bulbs, switches, sockets, and associated accessories) strictly adhering to the technical sp ecifications, quantities, and delivery mentioned in the Bid 1.2 The material shall be supplied strictly in accordance with the approved technical specifications and accepted GeM contract
• 2.General Terms & Conditions 2.1 The bidder shall carefully read and accept all specifications, terms and conditions mentioned in the GeM bid before submitting the offer. 2.2. The products offered must conform to the technical specifications mentioned in the BOQ and bid d ocument. 2.3. The bidder shall submit all required documents within the stipulated time. 2.4. All items supplied shall be new, unused, genuine and free from manufacturing defects. 2.5. The supplier shall be responsible for transportation, delivery and installation (where specified in the BOQ). 2.6. The bidder must comply with applicable statutory requirements, BIS standards, safety regulations a nd carry valid ISI marking where applicable. 2.7. Brands / Makes Required ​All items supplied under this contract must strictly belong to reputed, buyer-approved OEMs (e.g., Havells, Crompton, Philips, Wipro, Legrand, Anchor/Panasonic, Orient or equiv alent authorized makes). Items from unbranded or non-listed manufacturers will be rejected automatically .
• 3.Technical Specifications & Compliance 3.1. The bidder shall submit a technical compliance statement against each item mentioned in the bid. 3.2. The manufacturer name, brand, model number and technical specifications shall be clearly mentio ned in the bid. 3.3. The offered product must meet or exceed the minimum technical specifications specified in the bid . 3.4. The buyer reserves the right to verify the technical specifications, product catalogue and manufact urer details. 3.5 The bidder shall carefully examine all item descriptions, dimensions, sizes, materials and quantitie s before submitting the bid. 3.6 The bidder shall upload relevant product catalogues, technical datasheets or manufacturer specific ations wherever required for verification. 3.7 Any deviation from the prescribed specifications shall be clearly indicated by the bidder. Unstated deviations shall not be presumed acceptable.
• 4.Material Quality & Workmanship. 4.1 All supplied items shall be of satisfactory commercial quality and suitable for their intended plumbi ng application.
• 5.OEM / Authorised Dealer Requirement. The bidder other than OEM shall upload bid speci fic authorization on OEM letter head. The OEM authorisation must correspond to the offered brand and pro duct category. The buyer reserves the right to verify the authenticity of the submitted authorisation.
• 6.Warranty The supplier shall provide a warranty for the period specified in the GeM bid. Warrant y shall cover manufacturing defects and failures attributable to the supplied product under normal operati ng conditions. Defective items shall be repaired or replaced by the supplier as per the applicable warranty terms. Warranty documents shall be provided along with the supply, where applicable and Supplier shall provide the manufacturer's warranty details for each product.
• 7.The supplier shall coordinate with the consignee for delivery and installation requirements.
• 8.Any damage during transportation shall be the responsibility of the supplier as per the contract ter ms.
• 9.Inspection & Acceptance The supplied items shall be inspected by the consignee / authorise d inspection authority. Inspection may include verification of:- 9.1 Quantity. 9.2 Brand and model. 9.3 Technical specifications. 9.4 Physical condition. 9.5 Accessories. 9.6 Warranty documents.
• 10.Items not conforming to the approved specifications may be rejected in accordance with the applicabl e contract terms. Acceptance shall be subject to satisfactory compliance with the contractual requirement

• 11.Documents to be Submitted by Bidder The bidder shall submit the following documents, w herever applicable and required by the bid:-
• (a)Technical compliance statement.
• (b)Manufacturer / brand details.
• (c)Product datasheet.
• (d)OEM authorisation, if required.
• (e)BIS / applicable compliance documents.
• (f)Warranty undertaking.
• (g)GST registration details.
• (h)PAN details.
• (j)Past supply / experience documents, if specified.
• (k)Bidder upload notarized affidavit not older than six months regarding non blacklisted/ non debarre d from any Govt Deptt.
• (l)MII Certificate are required on letter head of OEM/ Supplier.
• (m)Any other documents required in the GeM bid.
• (n)Acceptance of applicable GeM terms and conditions
• 12.Bidder shall quote the rate of supply of goods incl transport at consignee location as directed by consi gnee.
• 13.EMD as required is compulsory by the department as mentioned in the bid and EMD Should reach this office within 05 working days from bid opening date in token of uploaded EMD Extract, failing which bidder will be disqualified. The EMD will be returned as per GTC Stipulated time frame.
• 14.Bidder last three year annual turnover should be duly verified by CA.
• 15.Price & Taxes The quoted price shall be inclusive of all applicable charges as specified in th e GeM bid. GST shall be indicated separately or included as required by the GeM bidding format. The bidd er shall ensure that the quoted price covers all costs required to fulfil the contractual scope.
• 16.Rejection of BID The bid may be rejected in accordance with applicable GeM rules and bid con ditions if:- 16.1 The bidder fails to submit mandatory documents. 16.2 The offered product does not meet the specified technical requirements. 16.3 Submitted documents are found to be invalid or unverifiable. 16.4 The bidder provides misleading or materially incorrect information. 16.5 The bidder fails to comply with mandatory ATC requirements.
• 17.Delivery Conditions 17.1 The material shall be delivered to the consignee location specified in the GeM contract within the st ipulated delivery period. 17.2 The seller shall be responsible for safe packing, transportation and delivery of the material. 17.3 The material shall be properly packed to prevent damage during transportation and handling. 17.4 No additional transportation, packing or forwarding charges shall be payable beyond the acc epted contract value, except as expressly permitted under the contract.
• 18.Inspection & Acceptance 18.1 The supplied material shall be subject to inspection by the consignee or an authorized inspection authority. 18.2 Inspection shall include verification of quantity, dimensions, material, workmanship and compliance with the approved specifications. 18.3 The Buyer reserves the right to reject material that does not conform to the accepted specifications or contractual requirements. 18.4 Defective, damaged or non-conforming items shall be replaced by the seller at no additional cost, i n accordance with applicable contractual provisions. 18.5 Acceptance of the material shall be subject to satisfactory inspection and verification. 18.6. If any document or declaration is found to be false, fabricated or misleading, action may be taken i n accordance with applicable GeM terms and Government rules. 18.7 The bidder shall be responsible for the correctness and authenticity of the information submitted w ith the bid.
• 19.Demurrage Charges. In case the rejected items are not lifted by the firms within 48 hrs , the dem urage charges at the rate of 0.5% of total contract value will be charged per day. In case the items are not lifted within a month, the same will be destroyed by the station board of officers and no claim will be admi tted.
• 20.Compliance with GeM Terms & Conditions All other terms and conditions shall be governed by the applicable GeM General Terms & Conditions (GTC), bid document and relevant procurement regulat ions .

While generating invoice in GeM portal, the seller must upload scanned copy of GST invoice and the screenshot of GST portal confirming payment of GST.

• 5.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.
• 6.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. IMPORTED PRODUCTS: In case of imported products, OEM or Authorized Seller of OEM should have a registered office in India to provide after sales service support in India. The certificate to this effect should be submitted.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

Material Test Certificate Should Be Sent Along with The Supply. The Material Will Be Checked by Buyer’s Lab & the Results of the Lab will be the Sole Criteria for Acceptance of the Item.

The bidder is required to upload, along with the bid, all relevant certificates such as BIS licence, type test certificate, approval certificates and other certificates as prescribed in the Product Specification given in the bid document.

To be eligible for award of contract, Bidder / OEM must possess following Certificates / Test Reports on the date of bid opening (to be uploaded with bid): AS PER BID .

• 13.Past Project Experience Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. Contract copy along with Invoice(s) with self-certification by the bidder that service/supplies against the invoices have been executed.b. Execution certificate by client with contract value.c. Any other document in support of contract execution like Third Party Inspection release note, etc.Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. Contract copy along with Invoice(s) with self-certification by the bidder that service/supplies against the invoices have been executed.b. Execution certificate by client with contract value.c. Any other document in support of contract execution like Third Party Inspection release note, etc.

Successful Bidder can submit the Performance Security in the form of Fixed Deposit Receipt also (besides PBG which is allowed as per GeM GTC). FDR should be made out or pledged in the name of COMMANDER WORKS ENGINEER A/C (Name of the Seller). The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of Security Deposit, the FDR will be released in favour of bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.
