DEMAND OF SPARES FOR STONE CRUSHER PARISHRAM 20 TPH

Actual delivery (and Installation & Commissioning (if covered in scope of supply)) is to be done at following address OFFICER COMMANDING HQ 1072 FIELD WORKSHOP (GREF) BOLENG, SIANG ARUNACHAL PRADESH PIN 791004 .

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

• a.Copy of PAN Card.
• b.Copy of GSTIN.
• c.Copy of Cancelled Cheque.
• d.Copy of EFT Mandate duly certified by Bank.

Manufacturer Authorization:Wherever Authorised Distributors/service providers are submitting the bid, Authorisation Form /Certificate with OEM/Original Service Provider details such as name, designation, address, e-mail Id and Phone No. required to be furnished along with the bid

OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 50 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 50% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Shelf Life: The Product/Spare parts to be supplied as part of the services must have minimum 2 YEARS Shelf Life. On the date of supply, minimum 1 YEAR usable shelf life should be available / balance.

• 1.The Seller shall not assign the Contract in whole or part without obtaining the prior written consent of buyer.
• 2.The Seller shall not sub-contract the Contract in whole or part to any entity without obtaining the prior written consent of buyer.
• 3.The Seller shall, notwithstanding the consent and assignment/sub-contract, remain jointly and severally liable and responsible to buyer together with the assignee/ sub-contractor, for and in respect of the due performance of the Contract and the Sellers obligations there under.

Without prejudice to Buyer’s right to price adjustment by way of discount or any other right or remedy available to Buyer, Buyer may terminate the Contract or any part thereof by a written notice to the Seller, if:

• i)The Seller fails to comply with any material term of the Contract. ii) The Seller informs Buyer of its inability to deliver the Material(s) or any part thereof within the stipulated Delivery Period or such inability otherwise becomes apparent. iii) The Seller fails to deliver the Material(s) or any part thereof within the stipulated Delivery Period and/or to replace/rectify any rejected or defective Material(s) promptly. iv) The Seller becomes bankrupt or goes into liquidation.
• v)The Seller makes a general assignment for the benefit of creditors. vi) A receiver is appointed for any substantial property owned by the Seller. vii) The Seller has misrepresented to Buyer, acting on which misrepresentation Buyer has placed the Purchase Order on the Seller.

While generating invoice in GeM portal, the seller must upload scanned copy of GST invoice and the screenshot of GST portal confirming payment of GST.

Scope of supply (Bid price to include all cost components) : Only supply of Goods

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

• (a)Above spares must be compatible to be fitted on Stone Crushers Parishram 20 TPH.
• (b)Bid is open for OEM/Authorized dealer/Retailer/Local Dealer deal with Crusher Spares.
• (c)Inspection of Stores:– Items supplied Cat -A Spares to be checked by a Board of Officer detailed by a ccepting/competant officer. The stores should be as per specification mentioned in GeM Contract. Stores w ill be provided for inspection within the delivery period by the concerned supplier.
• (d)Genuine Spares parts (Parishram) of requisite quality will be accepted as mentioned in BO

Q.

• (e)Rejected Stores:- All rejected stores are liable to be back loaded to the Supplier concerned by the Co nsignee/collection agency at risk and cost of the supplier/firm (incase stores not accepted/found correct by consignee/collection party).
• (f)Firm is responsible for unloading of Spares at this Wksp location. No payment or additional loading/unlo ading charge will be claim by seller.
• (g)“Partial order/part supply shall not be accepted under any circumstances. The supplier shall be require d to execute the complete quantity of the Supply Order in full. Incomplete, fragmented, or part supply agai nst the ordered quantity is liable to be rejected.”

• 13.Warranty : Minimum 1 Year from the date of supply of Goods/Spares. Timely Servicing / rectification of defects during warranty period: After having been notified of the defects / service requirement during warranty period, Seller has to complete the required Service / Rectification wit hin 15 days time limit. If the Seller fails to complete service / rectification with defined time limit, a penalty of 0.5% of Unit Price of the product shall be charged as penalty for each week of delay from the seller. Sell er can deposit the penalty with the Buyer directly else the Buyer shall have a right to recover all such pena lty amount from the Performance Security (PBG).Cumulative Penalty cannot exceed more than 10% of the total contract value after which the Buyer shall have the right to get the service / rectification done from al ternate sources at the risk and cost of the Seller besides forfeiture of PBG. Seller shall be liable to re-imber se the cost of such service / rectification to the Buyer.
• 14.Performance cum Bank Guarantee Bond (E-PBG) : Performance guarantee to be furnished by successful Bidder, for ensuring due performance of the contra ct, by way of Bank Guarantee account payee Demand Draft/Fixed Deposit Receipt from a commercial ban k/Public sector/Private sector bank (Authorised to conduct government business). Performance Security 3% of the value of contract valid for 2 months beyond the date of completio n of all contractual obligations including warrantee obligations. In case of any extension of contract obl igation period, the seller shall be liable to suitably extend the validity of the Performance Security. Perform ance Security must be submitted by Seller to the Buyer within 15 days of award of contract on GeM. The payments to the seller shall become due only after receipt of Performance Security by the Buyer and v erification of its genuineness. No interest shall be payable upon the Performance Security / PBG or any oth er amounts payable by the Seller to the Buyer under the Contract. If the Seller fails or neglects to observe or perform any of his obligations under the contract it shall be lawf ul for the Buyer to forfeit either in whole or in part, the Performance Security furnished by the Seller. If the Seller duly performs and completes the contract in all respects the Buyer shall, refund the Performance Se curity, as the case may be, to the Seller within 30 days of completion of all contractual obligations by the Seller.
• 15.EMD/Bid Securities : Seller had to deposit of Bid Security @ 1% of estimated value of procurement. The same should be valid for 45 days beyond the bid validity. No interest shall be payable upon the Bid Security / EMD or a ny other amounts payable by the Seller to the Buyer under the Contract. The following categories of Sellers shall however, be exempted from furnishing Bid Security: Micro and Small Enterprises (MSEs) who are holding valid Udyam Registration and are manufacturer of the offered Product or Service (Primary Product / Service - in case of bunch bid with total value wise evaluation ) and give specific confirmation to this effect at the time of bid submission and claim EMD exemption and whose credentials are validated online through Udyam Registration website of Ministry of MSME and also t hrough supporting document uploaded during bidding process and validated by the Buyer. Bid Security submitted by the bidder shall be forfeited, if the bidder:
• i.Withdraws or modify or impairs or derogates from the bid in any respect within the period of vali dity of its bid; or If it comes to notice that the information / documents furnished in its bid is fals e, misleading or forged; orFails to furnish requisite performance security within stipulated time r equired as per e-bid / RA conditions. ii. If it comes to notice that the information / documents furnished in its bid is false, misleading or f orged; or iii. Fails to furnish requisite performance security within stipulated time required as per e-bid / RA conditions. Earnest money of unsuccessful bidders shall be returned within 15 days after the award of contract or e xpiry of bid validity, whichever is earlier. However, in case of two packet or two stage bidding, Bid securitie s of unsuccessful bidders during first stage i.e. technical evaluation should be returned within 15 days of d eclaration of result of first stage itself i.e. technical evaluation. Earnest money of successful bidder shall be returned within 15 days after receipt of Performance Security / e-PBG. .
