OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Buyer Added text based ATC clauses ADDITIONAL TERMS & CONDITIONS (ATC) – GeM CONTRACT 1. 1. Place of Delivery Delivery of items will be accepted only at Buyer’s location (Leh). No alternate delivery location will be entertained. 2. 2. Shelf Life No item will be accepted with less than 85% of the remaining shelf life at the time of deliv ery. 3. 3.Delivery Period Items are to be delivered strictly within the stipulated Delivery Period (DP) as mentioned in t he contract. No extension will be granted if the vendor requests for extension after expiry of the schedule d DP. 4. 4. No Part Supply Part/partial supply of items will not be accepted under any circumstances. The complete qua ntity must be supplied in one lot as per contract terms. 5. 5. Specification Compliance The composition/brand of the item quoted must be strictly adhered to. Supply of any item deviating from the quoted specification will be rejected. 6. 6. Vendor Certification (CDSCO Compliance) The vendor must furnish a certificate stating that they have not been blacklisted/banned by the Central Drugs Standard Control Organisation (CDSCO) or any Government agency. In case of any discrepancy found at a later stage, the contract shall be liable for cancellation. 7. 7. Responsibility for Wrong Supply In case of delivery of wrong item / incorrect composition / wrong brand, the entire responsi bility for collection/replacement of such items shall rest with the vendor. The vendor shall arrange collection from the delivery location (Leh) at their own cost without a ny liability on the buyer. .
