OPTION CLAUSE 25% : The buyer can increase or decrease the contract quantity or contract duration up to 25 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised quantity or duration. For lumpsum-based service contracts, the buyer may increase the scope of work and contract value up to 25 percent with the consent of the service provider

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Buyer Added text based ATC clauses 01- Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any respo nsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is l ower), subject to the maximum of quoted GST % 02- Supplier shall ensure that the Invoice is raised in the name of Consignee with GSTIN of Consignee only.

• 03.Replacement of trucks to be provided by bidder in case of mechanical failure/ any other failure in rout e at no extra cost.
• 04.Date of movement of trucks may be changed for which the successful bidder would be notified but no compensation shall be allowed for the same.
• 05.BSF will not be responsible for any incident/accident. No claim of any damage to men and material due to any mishap/accident will be entertained by BSF.
• 06.Buyer reserves the right to cancel the bid process at any stage without assigning any reason. 07 Dedicated toll-free telephone number:- Telephone number for service support: Bidder must have dedic ated toll free telephone number for service support.
• 08.Rate quoted by bidder will be inclusive of all charge like GST, Road Tax and Toll etc.
• 09.Bidder should ensure mentioning of bid No. and date in all the Undertaking/Declaration and certificate submitted along with the Bid. The document should not be signed/dated before bid publishing date or after bid opening date their bid shall be rejected. 10- 03 Horse Float Vehicles of 09 Horses or 05 Horse Float Vehicles of 06 Horses will be provided from STC BSF Kharkan Camp to STC Churachandpur (Manipur). In case of emergency, a backup of 06 horse float or 0 2 horse float vehicle will be provided depending on actual distance and usage. 11- Fitness of trucks- trucks must be fit to travel from STC Kharkan Camp to STC Churachandpur both in pl ain area & Hilly area. Fitness certificate of trucks must be deposit. 12- EMD Exemption: - The Bidder seeking EMD Exemption must submit the valid supporting documents for the relevant category as per GeM GTC with the bid. Under MSE/start-up category, only manufacturer/ servi ce provider of the product are the eligible for exemption from EMD. Traders/resellers are excluded from the preview of this policy. EMD/BID security is required to be submitted by the non-exempted categories the s eller will upload scanned copy of bank guarantee (EMD) alongwith technical bid documents and hardcopy o f the same will have to be submitted directly to buyer within 5 days of bid opening date. if bidder fail to su bmit hard copy of EMD within prescribed date then the offer shall be rejected at initial stage. and no repres entation will be entertained.
• 13.Bid securing Declaration:- EMD exempted categories seller will be submit a bid securing declaration ce rtificate as per Appendix "A" alongwith the technical bid documents. Otherwise their offer will be rejected at the initial stage and no representation shall be entertained. 14- Consideration of bidder/OEM turnover criteria. The minimum average annual financial turnover of the b idder/OEM of the offered product during the last 3 years ending on 31st March of the previous asseesment year, 2023-2024, 2024-2025, 2025-2026 and 2026-27 will only be considered. In case the date of constitut ion/ incorporation of the Bidder/OEM is less than 3 years old, the average turnover in respect of completed financial assessment years after the date of constitution shall be taken into account for this criteria. If the firm does not update the turnover details on the GEM portal duly verified from ITR for the last three assess ment financial years, the offer shall be rejected.
• 15.Conflict of interest. The bidder will submit their declaration in respect of conflict of interest as per appe ndix-C along with the bid document.
• 16.Undertaking certificate for cartel formation. Participating bidder is required to submit the undertaking c ertificate with the bid document regarding non -submission of bid through cartel formation as per appendix -D.
• 17.Undertaking certificate:- The bidder will submit an undertaking that their firm has never submitted any false/ fake/ adulterated or misleading documents in any government department in the last two years, an d their documents have never been found fake/ false/adulterated or misleading by any government depart ment in the last two years . If the undertaking is found false/ manipulative/ or misleading the firm shall be blacklisted for two years from BSF as per appendix-E .
• 18.Undertaking for supply of any contract issued:- The bidder has to give an undertaking that firm has not defaulted in the supply of any contract issued by any government department in the last two years in any consignee. If the undertaking is found false/ manipulative or misleading the firm shall be blacklisted for tw o years from BSF as per appendix-F.
• 19.Self-Declaration for not under watch listed/banned suspend.- Participating firm should submit a self-de claration that the bidder is not under watch list/ banned/ suspended or blacklisted by any government dep artment as per appendix-G.
• 20.Bidder’s financial standing: The bidder should not be under liquidation, court receiving or similar proce edings and should not be bankrupt. The bidder must upload an undertaking to this effect with the bid as p er appendix-H.
