• 1.Scope of Work: Lifting and Transportation of Periodic Overhauling (PO
• H)of RSP locomotives (04 sets) from M/s. GOC, Trichy to RSP, Rourkela and from RSP, Rourkela to GOC Trichy by Road on Door Delivery basis.
• 2.TOTAL CONTRACT WILL BE FOR TRANSPORTATION OF 4 (FOUR) SETS AS ME NTIONED ABOVE. 1 (One) set is equal to movement of 2 bogies from RSP to GOC, Trichy a nd vice versa. Accordingly, 4 sets mean movement of total 16 nos. of bogies. DETAILED WEIGHT & DIMENSION OF ONE BOGIE IS AS GIVEN BELOW:
• a)Approx. Weight: 24.00 MT per bogie
• b)Approx. dimensions: 6.5 m × 3.0 m × 1.5 m per bogie
• 3.TENTATIVE SCHEDULE OF TRANSPORTATION: Total Qty.: 4 Sets - 2 Set for the F/Y - 2026-27 - 2 Set for the F/Y - 2027-28
• 4.Transit time: Material to be lifted as per the instruction given by RSP. Tran sit time will be 8 days from date of lifting material (Excluding loading and un loading days) for each side of transportation.
• 5.Transit Insurance: Transit insurance for bogies from GOC, Trichy to RSP, Rourkela will be done by the transporter. Estimated cost of bogies (02 nos.) i s Rs. 60.00 Lakhs as per GOC, Trichy, Indian Railways letter.
• 6.The transporter shall be fully responsible for any loss, damage, accident or delay occurring during transportation.
• 7.Mode of transport: By road
• 8.The quantity may be enhanced up to 100% if further required by RSP.
• 9.The consignment shall be booked/carried at the risk and cost of the trans porter.
• 10.Proper safety of material is to be insured as per standard.
• 11.Delivery challan and E-way Bill, shall accompany the consignment.
• 12.Delayed delivery charge: 1% per day of delay in transit time, maximu m 5% of the transportation charge will be recovered from the bill of the tra nsporter.
• 13.In the event of delay in lifting, RSP reserves the right to arrange alter native source(s) for transportation of material at your risk & cost.
• 14.No detention charges will be paid extra at the point of loading or at th e point of unloading for any reason whatsoever.
• 15.All necessary road permits, toll charges, statutory clearances and other ap plicable charges shall be in the scope of the transporter.
• 16.PAYMENT: Payment shall be made on a lump-sum basis per set for the complete transportation route from RSP, Rourkela to GOC, Trichy and back to RSP, Rourkela, or vice versa, as applicable.
• 17.Delivery will be made in staggered manner as per requirement of RSP.
• 18.Tenure of Contract will be valid for two years from the placement of Ord er. The contract period may be extended for a period of 6 months at the di scretion of RSP Management, and a further period of 6 months on mutual consent of the parities. The rate, terms and conditions of the extended pe riod of Contract will be same as that of the Original Contract.
• 19.Vehicle to be placed at GOC Trichy as per requirement of RSP after place ment of order.
• 20.Freight bills to be submitted in triplicate along with receipted Con signment note, challan, invoices etc. to MM Stores – Consignment Control section for scrutiny and passing of the bills.
• 21.PAYING AUTHORITY: GM (F&A), Stores Bills, SAIL, RSP, Rourkela.
• 22.Consignee: GM I/C (MM–Stores), RSP, Rourkela. Freight bills shall be sub mitted in triplicate along with the receipted consignment note, delivery chal lan, invoice and other relevant documents to MM Stores – Consignment Cont rol Section for scrutiny and passing of bills.
• 23.The transporter shall arrange proper supervision at the time of lo ading. The transporter shall be responsible for any loss/damage to the m aterial during loading, transit and unloading attributable to the transport er. Any loss arising due to non-delivery, short-delivery or damage shall b e made good by the transporter.
• 24.PVC Clause: The transportation rates shall be linked to the price of diesel at Rourkela (Municipal Area) and the base date shall be the 1st dat e of on-line auction/Opening of price bid. Transportation Charge will increase/ decrease by 30% of the percentage inc rease/ decrease in the diesel price. Escalation/ De-escalation shall not be ad missible before minimum cumulative increase/ decrease of Rs.5 per Liter. Pr ice to be revised only once in a fortnight i.e. based on price of HSD ruling in Rourkela on 15th and last day of every month. No escalation in rates for an y other reason whatsoever will be entertained during the pendency of the C ontract. Price variation will as per below equation. Variation (V) = 0.3 x B x (D-D0)/D0 Where, B: Contracts rates as on base date D0: HSD Price per liter on base date at Rourkela. D: Revised prevailing market rate of HSD at Rourkela. New rate= B+V BREACH OF CONTRACT: In case of breach of any terms and conditions of the c ontract by the Transport Contractor, RSP management reserves the right to r ecover for the said breach, without prejudice to the other rights of RSP to rec over any further sum or cost of damages from any sum due or which may com e to be due to the Transport Contractor from RSP or other wise and terminate the Contract forthwith. RISK & COST: The Contractor shall ensure that the work entrusted to him und er the Contract is executed to the full satisfaction of RSP management. Failur e on his part to perform his / obligation under the contract to the full satisfac tion of RSP management the authority will be entitled for termination of the contract. In such an event the company shall get the work executed at the co ntractor’s risk and cost by alternative arrangement. Finalization of alternate Contract shall be done through Limited tender Enquiry/ spot offers route. ARBITRATION: In the event of any dispute or difference arising out of the contract, the same shall be referred to for the Arbitration of Sole Arbitrator nominated by an inst itution dealing with the arbitration as per their rule. Either of the party to thi s contract shall request the Director In charge of RSP to make a reference to such institution, for appointment of an arbitrator and for making an award in terms of Arbitration and Conciliation Act, 1996 by the said Sole Arbitrator. All sittings of the arbitration shall take place at Rourkela unless otherwise dir ected, supply/sale/ purchase/transportation of materials or execution of any work under the contract shall continue, if possible, during the arbitration pro ceedings and no payment due shall be withheld on account of such proceedin gs. It is a term of this arrangement that notwithstanding the manner in whic h the agreement has been reached, this agreement shall be deemed to have been formed entirely at Rourkela. All kinds of legal proceedings shall be cogn izable and tried only in appropriate court exercising territorial jurisdiction ov er RSP. LEGAL PROCEEDINGS: All kinds of legal proceedings against SAIL, RSP in any matter arising out of this contract/text be instituted in appropriate Civil Court at Rourkela. LEGAL JURISDICTION: All suits and legal proceedings by or against RSP in any matter arising out of the tender shall be triable only by the appropriate Civil C ourt at Rourkela. ACT COMPLIANCE: All formalities like Road Permits, PUC Certificates, License et
• c.required under the Motor Vehicle Taxation Act should be arranged by the Co ntractor. No letter of priority for purchase of new vehicles will be issued to the contractor by RSP. Vehicles engaged by transporters should have valid docume nts like road tax, insurance, PUC Certificates and should comply with Motor veh icle Act or any other law of the land for the purpose as applicable. The contract or will ensure that the traffic rules are strictly observed. Demurrage/ warfare c harges, detention charges, garage hamali, stationary insurance charges, godo wn rent etc. will not be paid extra. FORCE MAJEURE CLAUSE: The company and the contractor shall not in any way, liable for non-performance either in whole or in part in the contract or for delay in performance thereof in consequences of any legal strike, legal lock out, fire, flood or accident to machinery, riots/wars or other acts of God or insurrection o r restraints imposed by Government, act of legislature or Port Trust, Railways, Custom Authorities and movement/Civil Commotion/blockade/breaches of roads and bridges. On the occurrence of the force majeure conditions, the party conc ern shall notify the other party immediately. RISK PURCHASE: If the Supplier/Contractor fails to deliver the service either in full or in part, with in the prescribed delivery/contract period, the Purchaser shall be entitled at his option to take alternate procurement action, at the risk & cost of the supplier/c ontractor for the unsupplied portion of the goods/ items/services for which deliv ery has expired without cancelling the contract in respect of the stores not yet due for delivery, or to cancel the contract based on progress of work, including s tores not due for delivery, and, if thought fit/necessary, to purchase the stores a t the risk and cost of the Supplier. The price differential in case of higher cost to SAIL, if any, shall have to be borne by the defaulting supplier. Moreover, the def aulting supplier shall have no claim over the quantity, which they failed to suppl
• y.REJECTION OF OFFERS: In case any specific adverse report is received against a tenderer, as an informa tion or upon enquiry made by SAIL, in respect of capabilities, performance and f raudulent practice such as misrepresentation of facts and/or fudging/forging/te mpering of documents for participation in the tender process or to secure a cont ract or in execution of the contract by the tenderer, after receipt of tender, eve n after opening of price bid), the quotation/ tender submitted by such tenderer i s liable to be rejected on the basis of recorded reasons and with the approval of the Next Higher Authority. SECURITY DEPOSIT
• (a)Successful Tenderer shall have to furnish security deposit (5% of the order v alue) to indemnify the plant towards loss/damage to the consignment when the materials are in custody of transport contractors. This should be valid for a peri od of one year from the date of issue of Letter of Intent/formal order and subse quently the period may be extended in case Contract is extended by RSP.
• (b)Security deposit is liable to be encased/forfeited/appropriated towards any l oss, damage whatsoever that may be sustained by the purchaser, as a result of any act or omission on the part of contractor in violation of any terms and condi tions of the contract.
• (c)Immediately upon award of contract, the successful tender shall deposit security deposit and mobilize the resources for lifting of material within 15 days from the date of award of the contract. Acceptable Modes Security Deposit (SD): Security Deposit may be submitted in the form of online transfer, Demand Draft, Banker's Cheque, Bank Guarantee (BG) or Fixed Deposit Receipt (FDR) from any Scheduled Commercial Bank except Co-operative and Gramin Bank but shall not be accepted in cash. Bank guarantee should be operable & enforceable at any branch of Rourkela and same to be submitted by successful tenderer as per attached format within 15 d ays from the date of award of the contract. All bank charges shall be borne by t he Transporter. Stamp paper shall be purchased in the name of the concerned b ank and stamp paper shall be appropriate value. The date of purchase of stamp paper shall not prior to the date of issue of tender/contract as the case may be. BG Format is to be provided at the time of award of contract to the L1 bidder. In case the supplier/contractor delays submission of Security Deposit, a penalty of 0.2% of the original SD amount per completed day of delay, limited to an amo unt not exceeding 5% of the original SD amount shall be applicable. Payment for executed portion of order/contract should only commence on submission of requ isite SD. The same should be stipulated in the tender. No claim by th e Contractor for interest/ depreciation of the Security Deposit shall be admissibl

• 1.Bidders are requested to submit duly filled up, signed and stamped d eclarations as per attached format in Gem bid.
• 2.Total quantity of this bid is 4 Sets for 2 years. However, being a servi ce contract the total qty is mentioned as “1”. Bidders are requested to qu ote their price for total quantity for the whole period.
• 3.Successful bidder has to provide the unit wise price breakup of for placem ent of order.
• 4.In case any specific adverse report is received against a tenderer, as an information or upon enquiry made by SAIL, in respect of capabilities an d performance of the tenderer, after receipt of tender but before the ope ning of the Price Bids, the quotation / tender submitted by such tenderer i s liable to be rejected on the basis of recorded reasons and with the appr oval of the Next Higher Authority /Chief Executive Officer of the Plants/ Ch ief Executive of the Units. If such report is received after opening of the p rice bids, then also the quotation/ tender of that tenderer is liable to be re jected after recording the reasons and with the approval of the Next High er Authority / Chief Executive Officer of the Plants/ Chief Executive of the Units"
• 5.The firms participated in this bid shall be deemed to have accepted a ll terms and conditions of the bid. Hence, bidders may enquire the details before submission of bid.
• 6.Bidders must note that in case of submission of offer, it will be assu med that you have accepted and will abide by the following clause: - “Thi s is to undertake that while participating in this tender or the execution o f the contract thereafter, we shall not give or take, any financial or non-fin ancial bribe, to and from anyone and if we notice any such happening, we shall report it to SAIL vigilance.” .
