Buyer requirements & conditions

OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

  • a.Copy of PAN Card.
  • b.Copy of GSTIN.
  • c.Copy of Cancelled Cheque.
  • d.Copy of EFT Mandate duly certified by Bank.

Manufacturer Authorization:Wherever Authorised Distributors/service providers are submitting the bid, Authorisation Form /Certificate with OEM/Original Service Provider details such as name, designation, address, e-mail Id and Phone No. required to be furnished along with the bid

Supplier shall ensure that the Invoice is raised in the name of Consignee with GSTIN of Consignee only.

  • 1.The Seller shall not assign the Contract in whole or part without obtaining the prior written consent of buyer.
  • 2.The Seller shall not sub-contract the Contract in whole or part to any entity without obtaining the prior written consent of buyer.
  • 3.The Seller shall, notwithstanding the consent and assignment/sub-contract, remain jointly and severally liable and responsible to buyer together with the assignee/ sub-contractor, for and in respect of the due performance of the Contract and the Sellers obligations there under.

Without prejudice to Buyer’s right to price adjustment by way of discount or any other right or remedy available to Buyer, Buyer may terminate the Contract or any part thereof by a written notice to the Seller, if:

  • i)The Seller fails to comply with any material term of the Contract. ii) The Seller informs Buyer of its inability to deliver the Material(s) or any part thereof within the stipulated Delivery Period or such inability otherwise becomes apparent. iii) The Seller fails to deliver the Material(s) or any part thereof within the stipulated Delivery Period and/or to replace/rectify any rejected or defective Material(s) promptly. iv) The Seller becomes bankrupt or goes into liquidation.
  • v)The Seller makes a general assignment for the benefit of creditors. vi) A receiver is appointed for any substantial property owned by the Seller. vii) The Seller has misrepresented to Buyer, acting on which misrepresentation Buyer has placed the Purchase Order on the Seller.

  • A.Queries Submission Timeline: All prospective bidders are hereby instructed to submit any queries or requests for clarification related to t his tender within the timeline defined in GEM. Any queries received after the stipulated deadline will not be entertained or responded to by OIL. Queries must be submitted in writing via email to bijoy.basumatary @oilindia.in. Please ensure that the subject line of your email clearly states 'Tender Query - [Tender Nam e].
  • B.Avoidance of Extension for Bid Submission: Bidders are earnestly advised to ensure that their bid submissions are prepared and submitted in accordan ce with the deadlines specified in this tender document. OIL has taken all necessary steps to establish rea sonable timelines for the submission of bids to allow ample time for thorough preparation. As a matter of policy, OIL will only consider granting an extension of the bid submission due date as a one- time exception in situations deemed unavoidable. Such extensions will be granted solely at the discretion of OIL and only in response to a written request from the bidder, submitted in accordance with the proced ures outlined in this tender document. It is hereby emphasized that OIL will not entertain or consider any requests for an extension of the bid sub mission due date, except in cases where OIL deems such extension unavoidable and the bidder submits a f ormal written request, detailing the compelling circumstances necessitating the extension. Bidders are the refore strongly advised to refrain from seeking an extension of the bid submission due date unless absolut ely necessary due to unforeseen and unavoidable circumstances. By participating in this tender process, all bidders acknowledge and accept the terms and conditions outlin ed in this Avoidance of Bid Submission Due Date Extensions clause.
  • C.Bidders are advised to duly fill the uploaded Buyer Specification Document (ANNEXURE-I &II) & Buyer uploaded ATC document, confirming categorical compliance and submit the same along with the Bid.
  • D.Bidders shall duly fill and submit the Undertakings as per Exhibits-I, II, III, Proforma 1 & 2 provided in Bu yer uploaded ATC Document..
  • E.Bidders shall submit undertaking on Bidder’s financial standing as per Proforma-FS given in Buyer uploa ded ATC Document. .
