• 2.In case of offer submission by authorized bidders (dealer, channel partner etc.) of respective Manufact urer, valid authorization (Duly signed, stamped by OEM authorised Person with name, contact Number and Email ID) duly mentioning GeM bid number is required to be submitted along with the offer.
• 3.Offer submission by dealer of OEM: Bidder shall provide back-up guarantee of OEM for quality & work manship of the ordered item(s) at the time of supply. The bids submitted by the Sellers to whom LTE has been issued, shall only be considered for valuation: bids from any other Seller shall be treated as unsolicited in the instant procurement case. H owever, the firm(s) interested to be registered as a Seller to SAIL, should fill up the vendor registration form, hosted on the SAIL Tender website and complete the due process of registration with SAI L Plants / Units
• 4.Items must be supplied in Manufacturer’s Original Packing only.
• 5.Guarantee/ Warranty Clause: The Supplier Shall Guarantee/ Warranty for a period of 18 months from t he date of supply or 12 months from the date of commissioning whichever is earlier and in the event of Buyer finding, within the guarantee period, that the item accepted & supplied, is not performing as per the requirement in the Purchase Order, the Supplier shall be liable to replace the item free of cost on F OR BSP Stores basis, to the satisfaction of the Buyer.

• 7.Payment Terms: 100% against receipt and acceptance at BSP Stores, Delivery & Inspection: at BSP Sto res.
• 8.LD Clause- In event of supply not being effected within the contractual delivery schedule liquidated da mages @ 0.5%, not by way of penalty, of the value of the materials without taxes, duties & freight, per week or part thereof of delay, subject to maximum of 10%, (or as applicable in the case of MSE as per extant SAIL MSE guideline) is recoverable from the Supplier without prejudice to the rights of Purchase r to procure the balance material at the risk and cost of the Supplier. The payment or deduction of suc h damages shall not relieve the Supplier from the contractual obligations to complete the supply or bal ance portion thereof in time as stipulated in the Contract.
• 9.Risk Purchase: Subject to the terms and conditions of this Agreement, if the Supplier neglect s or fails t o perform the Agreement by the time or times agreed upon, for any reason other than Force Majeure, the Purchaser after having come to know of such negligence or non-performance, after giving 14 to 30 days’ notice or any such extended period that the Supplier and Purchaser may mutually agree, to the Supplier to rectify, shall take such action as it considers fit including but not limited to taking risk purc hase action for supply of the material, mitigating any losses, at the risk and cost of the Supplier as far as the undelivered quantity in that Delivery Period is concerned. The Right of the Purchaser for Risk Pu rchase Action is in addition to the Right of Purchaser to terminate the Contract due to the fault of the S upplier. The price differential in case of higher cost to SAIL, if any, shall have to be borne by the defaul ting Supplier. Moreover, the defaulting Supplier shall have no claim over the quantity, which they faile d to supply.
• 10.It may be noted that all post order activities (that is regularizing SAP order, material receipts & GRN, B ill processing and any other post order activity) shall be done outside GeM over SAIL BSP’s SAP. Vendo r to Create Tracking No. and enter their Invoice and Challan and other PO documents through Online V endor Bill submission Module through the Link https://eproc.sailbhilaisteel.com/irj/portal for smooth ent ry at Gate and subsequent Bill Payment.
• 11.BSP reserves the right to reject the offers based on documents submitted by bidder with/without seeki ng additional clarifications. Hence bidders are requested to submit the documents along with offers in totality.

• 13.Bidders must submit the following with the Offer:
• a.Signed and Stamped ATC document
• b.Valid GeM Bid Specific OEM Authorisation, if applicable
• c.Items to be delivered at Rajhara Mines Stores .
• d.Bidders shall submit technical catalogue of the offered Motor & signed confirmation to all the Motor para meters as per CHECKLIST attached. .
