OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Buyer Added text based ATC clauses 1.0 BID QUALIFICATION CRITERIA (BQC)- Technical Criteria 1.1 The bidder shall be either

• a)Indian manufacturer of Carbon Steel (CS) Pipe fittings/ Stainless Steel (SS) pipe fittings su pplied to any industries;

(OR)

• b)Authorized Agent/Authorized Dealer/Channel Partner of manufacturer of Carbon Steel
• (CS)Pipe fittings/ Stainless Steel (SS) pipe fittings supplied to any Industries.

(OR)

• c)Supplier/Vendor/Agency/firms not having authorisation from manufacturer but havin g experience in the supply of Carbon Steel (CS) Pipe fittings/ Stainless Steel (SS) pipe fittings to Petrochemical /Refinery Projects within India. 1.2 The bidder should have successfully executed (**) one purchase order for t he Supply of Carbon Steel (CS) Pipe fittings/Stainless Steel (SS) pip e fittings for a value not less than Rs. 3.0 Lakhs (excluding GST) in the l ast 7 years period ending the last day of the month previous to the one in w hich this tender is floated. Relevant PO Copy and Invoice Copy/ Lorry Receipt (LR) copy/ Completion Certificate/satisfactory Performance certificate/Payment advice against t he invoice/ Third party inspection certificate release note as a document ary evidence supporting the execution of this order to be attached along with technical bid. Note-1: (**) (i) In case more than one contract is emanating against one tender, al l such individual contracts are to be considered as single contract for evalu ation of credential of a bidder for meeting their experience criteria. (**) (ii) Further in case of rate contract, cumulative value of all release orders emanating from one rate contract shall be considered as single cont ract for evaluation of credential of a bidder for meeting their experience cri teria. Note 2:
• (i)A Job executed by a Bidder for its own plant/ projects cannot be consid ered as experience for the purpose of meeting requirement of BEC of th e tender. However, jobs executed for Subsidiary/ Fellow subsidiary / Hol ding company will be considered as experience for the purpose of meeti ng BEC subject to submission of tax paid invoice (s) duly certified by St atutory Auditor of the Bidder towards payments of statutory tax in supp ort of the job executed for Subsidiary /Fellow subsidiary / Holding compa ny. Such Bidders to submit these documents in addition to the documen ts specified to meet BEC.
• (ii)A job completed by the bidder as a sub-contractor can be accepted ag ainst the submission of the following documents in support of meeting B EC.
• (a)Copy of work order along with the schedule of rates by main co ntractor.
• (b)Copies of completion certificates from the end user/Owner/PMC and also from the main contractor. The completion certificate shal l have details like work order no/date, brief scope of work, ordere d & executed value of job, completion date etc., However, in case bidder is not able to furnish the completion certi ficates from the end user/Owner/PMC in his name then completio n certificate issued in the name of main contractor shall also cons idered as a proof of completion. • a.Bidders are required to submit all such past experience(s) (PTR) meeting the BEC along with relevant supporting documents in the first instance itself, along with the bid.
• b.Any other documents for meeting the BEC requirements shall be submitted along with Techno Commercial Bid (Part-I) Accordingly, only such past experience(s) shall be considered for qualificat ion, details of which are provided in the bid by the bidder and subsequentl y no additional past experience (PTR) shall be sought from the bidder. Note 1:
• a)Relaxation to MSE/ Start-up bidder: MSE: In line with the Government policy, qualified Micro and Small Scale Enterprises (MSEs) will be given relaxation up to 15% on prior exper ience. (For example, if BQC value applicable to other than MSE bidders is R
• s.100/-, the same shall be Rs. 85/- for MSE bidders). Start Up: No relaxation in the prior Turnover and & experience criteria f or Startups for this tender due to Public Safety, Health, Critical Safety, Op erations & equipment etc.
• b)Holiday / Negative listing: The bidder should not be under blac klist/Holiday list of MRPL or Ministry of Petroleum & Natural Gas (Mo PNG) or should not have been debarred by orders issued by DoE. Th e Bidder should submit an undertaking to this effect along with the technical bid.
• c)Bidders are required to submit all such past experience(s) ( PTR) meeting the BQC (Cl. No 1.0 above) along with relevant supporting documents in the first instance itself, along with t he bid. However, MRPL/MECON reserves the right to seek any additional supporting documents for meeting the BQC for onl y those past experiences (PTR) submitted along with the bid by email/portal. Accordingly, only such past experience(s) sh all be considered for qualification, details of which are provid ed in the bid by the bidder and subsequently no additional p ast experience (PTR) shall be sought from the bidder.
• d)Joint venture/ Consortium bids shall not be permitted for th is tender
• e)Procurement from A Bidder Which Shares a Land Border wit h India Compliance of Restrictions under Rule 144 (xi) of GFR 2017 as per DOE Order (Public Procurement No.4) dated 23.02.2023 (as ame nded from time to time) –Refer GeM GTC. Undertaking (format attached) with respect to Compliance of Restri ctions for Countries which share land border with India – as stipulat ed by Govt. of India.
• f)In absence of requisite documents MRPL//MECON reserve th e right to reject the bid without making any reference to the bidder. .
