Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Successful Bidder can submit the Performance Security in the form of Fixed Deposit Receipt also (besides PBG which is allowed as per GeM GTC). FDR should be made out or pledged in the name of WCL, WANI NORTH AREA A/C (Name of the Seller). The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of Security Deposit, the FDR will be released in favour of bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.

• 1.Inspection: - Inspection will be done by Dy. Manager (E&M), AHQ, WNA or his representative Electrical Foreman Incharge, BTS during progress of work / com pletion of work.
• 2.The tenderer is advised to see the quantum of work / site condition before sub mission of tender to avoid Further complications.
• 3.The party should provide all the materials of good quality. The party is advised to enclosed the copy of supplied material delivery challan along with the bill as per the BOQ.
• 4.Completion Period: -30 (Thirty) Days from the date of handing over of job / site.
• 5.The rates once awarded will remain firm for the entire period of contract / agr eement.
• 6.The total amount shall be quoted including GST in the GeM Portal.
• 7.The tenderer cannot transfer / sub let any part of work.
• 8.Bidder shall have registered with CMPF / EPF authority. Also, shall make neces sary CMPF / EPF payments as required under law.
• 9.Transportation: - Transportation of all materials shall be the responsibility of bidder.
• 10.Payment of Bill: -95 % payment will be made within 21 days after submissio n of bill and balance 5 % will be paid after satisfactory performance for 01 (On
• e)year from the date of completion of work.
• 11.Guarantee: - The work shall be guaranteed for a period of one (01) year fro m the date of completion. In case of pre-mature failure of the job within the gu arantee period the same will be repaired free of cost by the contractor as per i nstruction of Engineer Incharge. The inverter provided under the work shall car ry a guarantee/warranty for a period of ten (10) years. The original guarantee/ warranty certificate issued by the manufacturer shall be submitted to WCL upo n completion of the work.
• 12.Paying Authority: - Area Finance Manager, WCL, Wani North Area.
• 13.Bill should be submitted through Dy. Manager (E&M), AHQ, WNA to S.O. (E&M ), Wani North Area with necessary certification of satisfactory completion of wo rk.
• 14.Scope of work: - As specify in the bill of quantities. All materials and consum able with labour charges as covered in BOQ will be provided by the contractor / bidder.
• 15.WCL, in no case shall be liable to pay any compensation to the staff / workme n in case of any injury/death of the workmen / staff etc. during the execution of the work. The contractor is to meet all expenses in such cases as per law.
• 16.The contractor shall ensure all safety measures for his workmen engaged for the jo b as well as men, material and equipment’s of WCL. The contractor shall provide saf ety equipment like safety belt, insulated tools etc. as required and all safety rules a nd regulation shall be observed by the contractor as applicable.
• 17.Liquidated Damages Clause: - If the contractor fails to maintain the require d progress in terms of the agreed time &progress chart or to complete the wor k on or before the scheduled date or extended date of completion, he shall, wit hout prejudice to any other right or remedy available under the law to the com pany on account of such breach, pay as compensation (Liquidated Damages) @ half percent (1/2 %) of the contract price per week of delay. The aggregate of such compensation / compensations shall not exceed 10% (Ten) percent of t he total value as shown in the contract.
• 18.Force Majeure clause: - If the execution of the work by the tenderer / bidder is delayed beyond the period stipulated in the contract / work order as a result of outbreak of hostilities, declaration of an embargo or blockade or fire, flood, a cts of nature or any other contingency beyond the tenderer / bidders control d ue to Act of God, then Western Coalfields Limited may allow such additional ti me by extending the delivery period, as it considers to be justified by the circu mstances of the case and its decision shall be final.
• 19.The management reserves the right to accept / reject any or all tenders, split the work amongst more than one tenderer without assigning any reason whats oever.
• 20.All the corrigendum and amendments issued on website or otherwise from thi s office regarding this NIT shall be responsibility of the tenderers to comply wit

h.

• 21.Extension of Completion period: - If the execution of work by the tenderer is delayed beyond the stipulated period due to delay in handing over the work s as mentioned. WCL may allow such additional time by extending the comple tion period.
• 22.If any tenderer declines to execute and carry out the work after acceptance of their tender, without prejudice, WCL, shall have right to terminate the work or der after forfeiting the EMD and taking any other action deemed fit without ass igning any reason whatsoever.
• 23.Engineer-Incharge: Staff Officer(E&M), AHQ, WNA or his authorized representative will be Engineer-Incharge for this work.
• 24.Termination of Contract: -The company shall, in addition to other remedial steps to be taken as provided in the conditions of contract be entitled to cance l the contract in full or in part, if the contractor: - Makes default in proceeding with the works with due diligence and continues t o do so even after a notice in writing from Engineer-In-charge, then on the expi ry of the period as specified in the notice. Or Commits default/ breach in complying with any of the terms and conditions of the contract and does not remedy it or fails to take effective steps for the reme dy to the satisfaction of the Engineer-In-charge, then on the expiry of the perio d as may be specified by the Engineer-In-charge in a notice in writing.
• 25.In case of electrical jobs one electrical supervisor (valid license holder) should be deployed for executing the jobs at our site. The contractor shall also ensure that only VTC trained workmen are deployed during execution of work. .
