• It will be responsibility of suppliers to upload clear/visible documents in support of their claim and no back reference will be made for submission of such documents.

• Tenders submitted online through IREPS only will be considered. All corrigenda to this tender will also be issued online through IREPS and bidders are advised to keep a watch for such corrigenda, if any and quote their bids accordingly.

• All conditions shall be as per tender document.

• This tender complies with Public Procurement Policy (Make in India) Order - 2017, revised date 16-09-2017., issued by Department of Industrial Promotion and Policy, Ministry of Commerce, circulated vide Railway Board letter No. 2015/RS(G)/779/2/Pt.1 dated 25.09.2020 and 2020/RS(G)779/2/Pt.1 (E3322671) dt.20.08.2024.

• This tender complies with Public Procurement Policy for MSEs Order - 2012, issued by Ministry of MSMEs, circulated vide Railway Board letter No. 2010/RS(G)/363/1 dt. 05.7.2012.

• Security Deposit (SD)/Performance Security is applicable in this tender. For exemption and other details refer para 14 of Instructions to Tenderer fore- tender.

• In case of any contradiction or conflict between special tender conditions to that of General tender conditions and / or and instructions to tenderers, the special tender conditions will prevail.

• Acceptance of Tender

  1. The purchaser reserves the right to reject any or all of the tenders in part or full at his sole discretion without assigning any reasons.
  2. Railways does not pledge itself to accept the lowest or any tender and reserves to itself the right of acceptance of the whole or any part of the quantity offered. The decision of Railways with regard to allotment of quantity so as to ensure uninterrupted supply of materials will be final.
  3. The acceptance of the tender will be communicated by letter of acceptance direct to the tenderer. In case where a counter offer is issued, the unconditional acceptance of counter offer will result in a validly concluded contract.

• Unloading at consignee end will be done by the supplier at their own cost.

• Warranty/Guarantee shall be as per specification. If not mentioned in the specification, then Warranty/Guarantee shall be as per IRS conditions of contract.

• 1. For Offers with FOR:- Ex-Works, the date of receipt of material at Consignee/Depot will be recorded as the actual date of supply in case of dispatch of material by mode other than Rail.
  2. Firms shall quote, with Dispatch mode as either Road or Consignee Destination Railway Station only. Offers received with Consignee nearest Railway Station maybe liable to be ignored.

• a.) Firms are advised to supply the material duly embossing/engraving or stenciling with permanent marker the name of manufacturer/supplier and year of manufacture at a place which is preferably visible and shall not get worn out during service. b.) If none of the above is possible the same to be marked on packing.

• Liquidated Damages (LD) - Extension of Delivery Period will be considered in deserving cases where genuine reasons exist. Such extensions of delivery period may be considered with liquidated damages as per IRS Conditions of Contract and Denial Clause. Railways shall recover from the contractor/firm as agreed Liquidated Damages and not by way of penalty, a sum equivalent to 1/2% (half percent) of the price of any stores(including elements of taxes,duties,freight, etc.) which the contractor has failed to deliver within the period fixed for delivery in the contract or as extended for each week or part of a week during which the delivery of such stores may be in arrears where delivery thereof is accepted after expiry of the aforesaid period, subject to a maximum of 10% (ten percent) of the value of the contract irrespective of delays, unless otherwise provided specifically in the contract.
