OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

• a.Copy of PAN Card.
• b.Copy of GSTIN.
• c.Copy of Cancelled Cheque.
• d.Copy of EFT Mandate duly certified by Bank.

Data Sheet of the product(s) offered in the bid, are to be uploaded along with the bid documents. Buyers can match and verify the Data Sheet with the product specifications offered. In case of any unexplained mismatch of technical parameters, the bid is liable for rejection.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Nominated Inspection Agency: On behalf of the Buyer organization, any one of the following Inspection Agency would be conducting inspection of stores before acceptance: Pre-dispatch Inspection at Seller Premises (applicable only if pre-dispatch inspection clause has been selected in ATC): NOT APPLICABLE Post Receipt Inspection at consignee site before acceptance of stores: AREA ENGINEER (E&M)

Buyer Added text based ATC clauses

• 1.Proven-ness Criteria: The tendered item shall be considered proven provided the tendered same/ hig her specifications/ ratings/ versions, etc. have been supplied during the last 5 years from the date of tende r opening against orders of CIL and its subsidiaries, other PSUs, Government Departments and listed Privat e Organizations and their performance has been found satisfactory. Documents to be submitted for proven-ness:
• i.Self-Certified Copy of past supply order in respect of tendered items received during last five years to CI L and its subsidiaries, other PSUs/ Government organization, listed private organization. ii. Self-certified copy of Proof of supply made against the supply order submitted such as self-certified copy of delivery challan/invoice/e-way bill etc.
• 2.Letter of Bid: The bidder has to submit Letter of Bid along with the bid as per the format attached in t he ATC document.
• 3.Fitment Guarantee: The goods should properly fit in/on/to the machines without any modification / alt eration for which the same are intended. A certificate in this respect should be given along with each supp ly. It must also be guaranteed that the offered materials shall be the exact replacement of the existing par ts in respect of fitment, safety & quality. If any of the materials supplied either do not fit properly on the m achine or it is established that some other parts of the machine have been damaged due to use of the sup plied materials, all such parts so damaged as well as the materials supplied shall have to be replaced on fr ee of cost basis within 30 days of getting intimation from the user project or consignee.
• 4.Manufacturer Authorization: The bidder (Authorized Agent) has to submit Bid Specific Authorization from the Manufacturer.
• 5.TReDS: Trade Receivables Discounting System (TReDS) is an initiative of Reserve bank of India (RBI) to facilitate MSME receivable payments from corporates. ECL has on boarded TReDS platform through (1) Re ceivables Exchange of India Ltd (RXIL) (URL - https://www.rxil.in/Home/Index) (2) ATReDs (URL - www.invoi cemart.com) (3) Mynd Solutions (URL -www.m1xchange.com). MSE bidders willing to get payment through this system may get registered on the above TReDS platform and confirm in offer and the same would be mentioned in the purchase order. • 6.Warranty: Warranty period of the supplied products shall be 1 year from the date of final acceptance o f goods. Warranty certificates must be submitted by successful bidder at the time of delivery of Goods. Th e seller should guarantee the rectification of goods in case of any break down during the warranty period.
• 7.Lowest Price Certificate: The successful bidder shall submit Lowest Price Certificate along with the bi ll as per the format attached in the ATC document. Note: All provisions of the CIL Purchase Manual, 2020 and its latest amendments, as applicable, shall be b inding and applicable to this bid/contract. .
