OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

While generating invoice in GeM portal, the seller must upload scanned copy of GST invoice and the screenshot of GST portal confirming payment of GST.

• 3.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

Warranty period of the supplied products shall be as given in specifications from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.

IMPORTED PRODUCTS: In case of imported products, OEM or Authorized Seller of OEM should have a registered office in India to provide after sales service support in India. The certificate to this effect should be submitted.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

Material Test Certificate Should Be Sent Along with The Supply. The Material Will Be Checked by Buyer’s Lab & the Results of the Lab will be the Sole Criteria for Acceptance of the Item.

The bidder is required to upload, along with the bid, all relevant certificates such as BIS licence, type test certificate, approval certificates and other certificates as prescribed in the Product Specification given in the bid document.

• 11.Past Project Experience Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. Contract copy along with Invoice(s) with self-certification by the bidder that service/supplies against the invoices have been executed.b. Execution certificate by client with contract value.c. Any other document in support of contract execution like Third Party Inspection release note, etc.Proof for Past Experience and Project Experience clause: For fulfilling the experience criteria any one of the following documents may be considered as valid proof for meeting the experience criteria:a. Bidders can also submit the EMD with Account Payee Demand Draft in favour of COMMANDER WORKS ENGINEER payable at CWE . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Successful Bidder can submit the Performance Security in the form of Account Payee Demand Draft also (besides PBG which is allowed as per GeM GTC). DD should be made in favour of COMMANDER WORKS ENGINEER payable at CWE . After award of contract, Successful Bidder can upload scanned copy of the DD in place of PBG and has to ensure delivery of hard copy to the original DD to the Buyer within 15 days of award of contract.

• 1.Scope of Procurement 1.1 The contract covers the supply and delivery of Building & Road plumbin g, Hardware and sanitary Fixtures strictly adhering to the technical description, units of measurement, specifications and quantities mentioned in the Bid. 1.2 The material shall be supplied strictly in accordance with the approved t echnical specifications and accepted GeM contract
• 2.General Terms & Conditions 2.1 The bidder shall carefully read and accept all specifications, terms and c onditions mentioned in the GeM bid before submitting the offer. 2.2. The products offered must conform to the technical specifications menti oned in the BOQ and bid document. 2.3. The bidder shall submit all required documents within the stipulated tim
• e.2.4. All items supplied shall be new, unused, genuine and free from manufac turing defects. 2.5. The supplier shall be responsible for transportation, delivery and installatio n (where specified in the BOQ). 2.6. The bidder must comply with applicable statutory requirements, BIS sta ndards and safety regulations.
• 3.Technical Specifications & Compliance 3.1. The bidder shall submit a technical compliance statement against each item mentioned in the bid. 3.2. The manufacturer name, brand, model number and technical specificati ons shall be clearly mentioned in the bid. 3.3. The offered product must meet or exceed the minimum technical specif ications specified in the bid. 3.4. The buyer reserves the right to verify the technical specifications,product catalogue and manufacturer details. 3.5 The bidder shall carefully examine all item descriptions, dimensions, sizes, materials and quantities before submitting the bid. 3.6 The bidder shall upload relevant product catalogues, technical datashee ts or manufacturer specifications wherever required for verification. 3.7 Any deviation from the prescribed specifications shall be clearly indicate d by the bidder. Unstated deviations shall not be presumed acceptable.
• 4.Material Quality & Workmanship. 4.1 All supplied items shall be of satisfactory commercial quality and suitabl e for their intended plumbing application. 4.2 Brass, PTMT, PVC, glass, mirror and other materials shall conform to the respective specifications mentioned in the Bid. 4.3 Chrome-plated items shall have a uniform finish and be free from visible defects. 4.4 Valves, cocks and fittings shall be suitable for their intended application and shall not exhibit leakage under normal operating conditions. 4.5 Glass and mirror items shall be supplied without cracks, chips or other defects affecting their intended use.
• 5.OEM / Authorised Dealer Requirement. The bidder other than OEM shall upload bid specific authorization on OEM letter head. The OEM autho risation must correspond to the offered brand and product category. The buyer reserves the right to verify the authenticity of the submitted authorisation.
• 6.Warranty The supplier shall provide a warranty for the period specif ied in the GeM bid. Warranty shall cover manufacturing defects and failures att ributable to the supplied product under normal operating conditions. Defective items shall be repaired or replaced by the supplier as per the applicable warrant y terms. Warranty documents shall be provided along with the supply, where a pplicable and Supplier shall provide the manufacturer's warranty details for eac h product.
• 7.The supplier shall coordinate with the consignee for delivery and installa tion requirements.
• 8.Any damage during transportation shall be the responsibility of the supp lier as per the contract terms.
• 9.Inspection & Acceptance The supplied items shall be inspecte d by the consignee / authorised inspection authority. Inspection may include ve rification of:- 9.1 Quantity. 9.2 Brand and model. 9.3 Technical specifications. 9.4 Physical condition. 9.5 Accessories. 9.6 Warranty documents.
• 10.Items not conforming to the approved specifications may be rejected in ac cordance with the applicable contract terms.Acceptance shall be subject to satisfactory compliance with the contractual requirements.
• 11.Documents to be Submitted by Bidder The bidder shall subm it the following documents, wherever applicable and required by the bid:-
• (a)Technical compliance statement.
• (b)Manufacturer / brand details.
• (c)Product datasheet.
• (d)OEM authorisation, if required.
• (e)BIS / applicable compliance documents.
• (f)Warranty undertaking.
• (g)GST registration details.
• (h)PAN details.
• (j)Past supply / experience documents, if specified.
• (k)Bidder upload notarized affidavit not older than six months regarding no n blacklisted/ non debarred from any Govt Deptt.
• (l)MII Certificate are required on letter head of OEM/ Supplier.
• (m)Any other documents required in the GeM bid.
• (n)Acceptance of applicable GeM terms and conditions
• 12.Bidder shall quote the rate of supply of goods incl transport at consignee lo cation as directed by consignee.
• 13.EMD as required is compulsory by the department as mentioned in the bid and EMD Should reach this office within 05 working days from bid opening d ate in token of uploaded EMD Extract, failing which bidder will be disqualified. T he EMD will be returned as per GTC Stipulated time frame.
• 14.Bidder last three year annual turnover should be duly verified by CA.
• 15.Price & Taxes The quoted price shall be inclusive of all applicable ch arges as specified in the GeM bid. GST shall be indicated separately or included as required by the GeM bidding format. The bidder shall ensure that the quoted price covers all costs required to fulfil the contractual scope. 1 6 . Rejection of BID The bid may be rejected in accordance with applicable GeM rules and bid conditions if:- 16.1 The bidder fails to submit mandatory documents. 16.2 The offered product does not meet the specified technical requiremen ts. 16.3 Submitted documents are found to be invalid or unverifiable. 16.4 The bidder provides misleading or materially incorrect information. 16.5 The bidder fails to comply with mandatory ATC requirements.
• 17.Delivery Conditions 17.1 The material shall be delivered to the consignee location specified in the GeM contract within the stipulated delivery period. 17.2 The seller shall be responsible for safe packing, transportation and deliv ery of the material. 17.3 The material shall be properly packed to prevent damage during tran sportation and handling. 17.4 No additional transportation, packing or forwarding charges shall be pay able beyond the accepted contract value, except as expressly permitted under the contract.
• 18.Inspection & Acceptance 18.1 The supplied material shall be subject to inspection by the consignee or an authorized inspection authority. 18.2 Inspection shall include verification of quantity, dimensions, material, wo rkmanship and compliance with the approved specifications. 18.3 The Buyer reserves the right to reject material that does not conform to the accepted specifications or contractual requirements. 18.4 Defective, damaged or non-conforming items shall be replaced by the se ller at no additional cost, in accordance with applicable contractual provisions. 18.5 Acceptance of the material shall be subject to satisfactory inspection and verification. 18.6. If any document or declaration is found to be false, fabricated or misleadi ng, action may be taken in accordance with applicable GeM terms and Govern ment rules. 18.7 The bidder shall be responsible for the correctness and authenticity of th e information submitted with the bid.
• 19.Compliance with GeM Terms & Conditions All other terms and c onditions shall be governed by the applicable GeM General Terms & Conditions
