OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidders shall quote only those products (Part of Service delivery) in the bid which are not obsolete in the market and has at least 2 years residual market life i.e. the offered product shall not be declared end-of- life by the OEM before this period.

Bidders are advised to check applicable GST on their own before quoting. Buyer will not take any responsibility in this regards. GST reimbursement will be as per actuals or as per applicable rates (whichever is lower), subject to the maximum of quoted GST %.

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

• a.Copy of PAN Card.
• b.Copy of GSTIN.
• c.Copy of Cancelled Cheque.
• d.Copy of EFT Mandate duly certified by Bank.

Data Sheet of the product(s) offered in the bid, are to be uploaded along with the bid documents. Buyers can match and verify the Data Sheet with the product specifications offered. In case of any unexplained mismatch of technical parameters, the bid is liable for rejection.

• 2.EXCEPT AS OTHERWISE PROVIDED IN THE INVITATION TENDER, THE SELLER HEREBY DECLARES THAT THE GOODS, STORES ARTICLES SOLD/SUPPLIED TO THE BUYER UNDER THIS CONTRACT SHA LL BE OF THE BEST QUALITY AND WORKMANSHIP AND NEW IN ALL RESPECTS AND SHALL BE STRI CTLY IN ACCORDANCE WITH THE SPECIFICATION AND PARTICULARS CONTAINED/MENTIONED IN C ONTRACT
• 3.IT WILL BE ENSURED THAT THE LIFE OF THE ARTICLE OFFERED ARE WITH FRESH DATE OF MAN UFACTURER AND SHOULD HAVE NOT PASSED MORE THAN 3/8TH OF THEIR USEFUL LIFE FROM TH E DATE OF MANUFACTURER AT THE TIME OF DELIVERY TO CONSIGNEE (1/3RD FOR IMPORTED GO ODS) AND THAT THE REMAINING USEFUL LIFE THAT SHALL STILL BE LEFT WOULD NOT BE LESS TH AN 5/8 SHELF LIFE. HOWEVER THIS CRITERIA CAN BE RELAXED IN CASE OF EXIGENCIES WITH REA SONS DULY RECORDED AND SHALL BE RESPONSIBLE FOR USE OF THAT STORES WITHIN ITS GIVE N SHELF LIFE AND ENSURE THAT THERE SHOULD NOT BE ANY LOSS TO THE STATE.LOSSES DURIN G THE PERIOD OF THE SHELF LIFE (2/3RD FOR IMPORTED GOODS) DUE TO BIOLOGICAL AND OTHE R ACTIVITIES WILL BE MADE GOOD BY THE SELLER FREE OF COST WITHIN 60 DAYS (EXCEPT IF DE CLARED DEFECTIVE/TOXIC WHEREIN THE COST OF THE ENTIRE BATCH WILL BE RECOVERED FROM THE FIRM). THE FIRM SHOULD SUBMIT A WRITTEN UNDER-TAKING DULY NOTARIZED ON JUDICIAL STAMP PAPER THAT IT WILL REPLACE THE UNCONSUMED STOCK 3 (THREE) MONTH PRIOR OF EXPI RY OF SHELF LIFE.
• 4.i. REPEAT ORDER CLAUSE: THE CONTRACT WILL HAVE A REPEAT ORDER CLAUSE, WHEREIN THE BUYER CAN ORDER UP TO 50% OF THE ORIGINAL ORDERED QUANTITY UNDER THE PRESENT CON TRACT WITHIN -06 MONTHS FROM THE DATE OF COMPLETION OF SUPPLY UNDER THIS CONTRACT, AT THE SAME TERMS & CONDITIONS OF THE PRESENT CONTRACT. THE BIDDER IS TO CONFIRM AC CEPTANCE OF THIS CLAUSE. IT WILL BE ENTIRELY THE DISCRETION OF THE BUYER TO PLACE THE REPEAT ORDER OR NOT. ii. REPEAT ORDER CLAUSE MAY BE EXERCISED MORE THAN ONCE, PROVIDED ADDITIONAL QUANTI TY ORDERED BY EXERCISING OPTION CLAUSE AND/OR REPEAT ORDER CLAUSE DOES NOT EXCEED 50% OF THE ORIGINAL ORDER QUANTITY.

Warranty period of the supplied products shall be 5 years from the date of final acceptance of goods or after completion of installation, commissioning & testing of goods (if included in the scope of supply), at consignee location. OEM Warranty certificates must be submitted by Successful Bidder at the time of delivery of Goods. The seller should guarantee the rectification of goods in case of any break down during the guarantee period. Seller should have well established Installation, Commissioning, Training, Troubleshooting and Maintenance Service group in INDIA for attending the after sales service. Details of Service Centres near consignee destinations are to be uploaded along with the bid.
