OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

• 3.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.
• 4.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

Timely Servicing / rectification of defects during warranty period: After having been notified of the defects / service requirement during warranty period, Seller has to complete the required Service / Rectification within 7 days time limit. If the Seller fails to complete service / rectification with defined time limit, a penalty of 0.5% of Unit Price of the product shall be charged as penalty for each week of delay from the seller. Seller can deposit the penalty with the Buyer directly else the Buyer shall have a right to recover all such penalty amount from the Performance Security (PBG).Cumulative Penalty cannot exceed more than 10% of the total contract value after which the Buyer shall have the right to get the service / rectification done from alternate sources at the risk and cost of the Seller besides forfeiture of PBG. Seller shall be liable to re-imberse the cost of such service / rectification to the Buyer.

NET WORTH: Net Worth of the OEM should be positive as per the last audited financial statement.

• 1.Bidder must be OEM or OEM authorized reseller. Certificate to this effect should be submitted by the bidder on OEM lette r head.
• 2.BIS Certificate
• 3.MII Certificate
• 4.Form GSTR-3B, last 3 years to be uploaded.
• 5.Copy of GSTIN
• 6.The firm should not be blacklisted or debarred from any Govt/PSU organization. A certificate regarding that bidder’s firm has not been blacklisted or debarred from any Govt/PSU organization duly Notarized on stamp paper of Rs 100/- (Rupees One hu ndred only) not later than six months to be uploaded on GeM portal by the firm.
• 8.A self-declaration on firm’s letter head to be attached regarding that they have completely understood all terms and condition in the bid and their acceptance to BoQ/product compliance along with the supporting documents.
• 9.Average Annual turnover of bidder for last three years duly verified by CA (Not for MSME and Startups).
• 10.Average Annual turnover of OEM for last three years duly verified by CA.

• 12.Past performance for same or similar category products not older than last three years in the form of GeM contract along with corresponding CRACs or executed through Govt departments to be uploaded along with completion certificates.

• 16.Copy of PAN Card Note:- (i) Collusion of IP address with any other bidder’s IP address due to any reason will result as disqualification in technical evaluation stage and no representation will be accepted.
• (ii)The buyer reserves the right to cancel/reject the bidder’s offer if the bidder doesn’t uploaded any of the certificates / doc uments sought in the Bid and as asked in terms and condition, ATC and Corrigendum if any.
• (iii)Certification as asked above in this ATC is required to maintain credibility/genuineness of supplier and quality control of p roduct being Defence Establishment.
• (iv)Test certificates on applicable items supplied shall be of either by NABL/Govt approved lab as required shall be submitted by the L1 bidder to consignee without any extra charges to the Govt.
• (v)If a firm quotes NIL charges/consideration, the bid shall be treated as unresponsive and will not be considered a nd will be rejected and no representation will be accepted.
• (vi)Inspection of stores supplied and Payment:-
• (a)Payment will be made only after the actual receipt and acceptance of all the store items as per GeM c ontract at consignee end after inspection through a Board of Officers constituted by Accepting Officer.
• (b)In case the store supplied is not found conforming to the required specifications and quality as per Ge M contract, the same either partly or fully will be rejected by the department at any stage and rejected store should be removed by the supplier within a week from the store premises. The supplier has to replace such re jected item with correct specification and quality as per GeM contract within stipulated time given in contract. The supplier will have no claim whatsoever on account of rejection of his offer which is without any prejudice. In this regard, the decision of Accepting Officer will be final and binding.
• (vii)Competent authority has right to cancel the contract and forfeit the Earnest money deposited and performance b ank guarantee submitted by the vendor and blacklisting of the firms in case contractor fail to execute the work as per GeM contract, or in case negligence in executing the contract, or in case of breach of contract. .
