Buyer Added text based ATC clauses DECLARATION (To be submitted with Technical Bid) It is to certify that the following points will be strictly followed in the GeM Bid No ………. Dt……………..

• 1.No counterfeit part will be used
• 2.Ensure that the documented information (e.g. requirements, design, verificatio n, validation and acceptance documentation) will be consistent and will be retai ned for a period of 2 years with the actual delivery of the product and/or service s or warranty period whichever is later.
• 3.Buyer/ End User/ Regulatory Authorities will have right of access to the organiza tion, their customer, and regulatory authorities to the applicable area of facilitie s & to applicable documented information, at any level of supply chain. ******************************************** Note :
• 1.Bidder has to provide Security Deposit cum Warranty Bond (ePBG) @5% of the contract value within 15 days of the date of contract positively, failing which Consignee Receipt & Acceptanc e Certificate (CRAC) cannot be generated and hence, the contract is liable to be rejected. The successful bidder would be required to submit the Performance Security cum Warranty Bo nd. In the event of the Seller’s failure to submit the BGs within 30 days of receipt of Supply Or der, the buyer may deduct from the seller as agreed, a sum of 0.5% of the value of the BG for every week or part thereof of delay as LD. Beyond 60 days, the procuring entity shall cancel th e Supply Order/Contract and impose a penalty and appropriate action would be taken.
• 2.Bidder has to provide compliance of Bid Document including all uploaded documents i.e VQC, Scope of Work, ATP, etc. duly Stamped and Signed, failing which the respective bid may not b e taken under consideration for evaluation. TERMS AND CONDITIONS
• 1.Firm has to provide support service as per scope of work and terms & conditions at ADRDE premis es / any other siteduring working hours i.e. 09:00 hrs -17:30 hrs (Monday to Friday). However, if req uired firm will have to perform Jobs beyond working hours as well as on Saturday & Sunday.
• 2.Firm has to provide all necessary supportas per scope of work at ADRDEduring working hours and/ or as desired by Rep. Director ADRDE, Agra.
• 3.The Contract shall be valid upto40 days from the date of supply order placed to perform the task t o be given as per scope of work.
• 4.The Director ADRDE has the discretion ‘to terminate’ the contract before completion of contractual period with or without assigning any reason.
• 5.The firm has to abide by the rules/regulation and discipline of ADRDE & strictly observe the discipli ne as instructed/advised by the ADRDE personnel.
• 6.The firm has to take utmost care and take standard engineering and safety precautions utilizing sa fety gears, shoes, dress, etc. during carrying out activities as mentioned in the scope of work.
• 7.In case of any accident or mishappeningleading to either injury or death of worker deployed for ex ecuting the job contract; Director, ADRDE Agra will not be liable for any reimbursement or any comp ensation, whatsoever.
• 8.ADRDE will not provide any free stay and food to Support Service renderers. Further, any service r enderer shall be replaced on request by ADRDE without assigning any reason.
• 9.In case of failure of firm to perform the contract satisfactorily, the order will be cancelled without a ny reimbursement & cost and a fresh contract will be entered in the risk & cost of the defaulting firm .
• 10.The losses to government properties, if any, during job contract, will be recovered from the firm’s p ayment. The damages/losses if any due to firm will be recovered from the firm. The firm will have to abide by all security instruction and requirements as necessary and intimated by ADRDE Agra.
• 11.For design & development activity all right are reserved with ADRDE (DRDO), firm should not publis h or share any information without permission of ADRDE.
• 12.Firm has to complete the task and deliver the service within timeframe of 40 days.
• 13.Firm has provide the Aadhar card & Police verification of manpower to be deployed at ADRDE
• 14.Firm has to submit Performance Bank Guarantee 5% after place of SO.
• 15.Time Schedule: The required services are tobe completed within 40 days from GeM Contract. Ho wever, if the firm is unable to deliver the services satisfactory the same may be terminated before th at timeframe. Payment Terms & Conditions The payment will be made as per the following terms
• 1.No advance or part payment will be given. 2. 100% payment within 30 days after receipt, satisfactory service certificat e issued by Rep. Director, ADRDE Agra or the date of receipt of the bill whi chever is later. Penalties Liquidated Damages: The Buyer may deduct from the Seller, as agreed, liquidated damages at the rate of 0.5% per week/ part thereof, of basic cost (excluding taxes and duties on final service) of the delayed service which th e seller has failed to deliver within the period agreed for delivery in the cont ract subject to maximum of 10% of the total order value (excluding taxes a nd duties on final product). In cases where partial service does not help in a chieving the objective of the contract, LD shall also be levied on the total co st (excluding taxes and duties on final product) of the ordered quantity deliv ered by the vendor. This will also include the completion of service within th e delivery period. .
