OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Bidder financial standing: The bidder should not be under liquidation, court receivership or similar proceedings, should not be bankrupt. Bidder to upload undertaking to this effect with bid.

Bidder shall submit the following documents along with their bid for Vendor Code Creation:

• a.Copy of PAN Card.
• b.Copy of GSTIN.
• c.Copy of Cancelled Cheque.
• d.Copy of EFT Mandate duly certified by Bank.

While generating invoice in GeM portal, the seller must upload scanned copy of GST invoice and the screenshot of GST portal confirming payment of GST.

Scope of supply (Bid price to include all cost components) : Only supply of Goods

• 6.Turnover Bidder Turn Over Criteria: The minimum average annual financial turnover of the bidder during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the bidder is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria.
• 7.Turnover OEM Turn Over Criteria: The minimum average annual financial turnover of the OEM of the offered product during the last three years, ending on 31st March of the previous financial year, should be as indicated in the bid document. Documentary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant / Cost Accountant indicating the turnover details for the relevant period shall be uploaded with the bid. In case the date of constitution / incorporation of the OEM is less than 3 year old, the average turnover in respect of the completed financial years after the date of constitution shall be taken into account for this criteria. In case of bunch bids, the OEM of CATEGORY RELATED TO primary product having highest bid value should meet this criterion.

IMPORTED PRODUCTS: In case of imported products, OEM or Authorized Seller of OEM should have a registered office in India to provide after sales service support in India. The certificate to this effect should be submitted.

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

Buyer Added text based ATC clauses

• 1.All GTC of GeM shall be applicable to this contract.
• 2.Prospective bidders are required to provide warranty certificate for every product as provided b y OEM. Warranty as per above clause is for replacement of defective item(s). Defective item /product will b e repla ced/Delivered within 30 days from the date of intimation given by the department at consignee loca tion o r as directed by consignee and suppliers shall bear all expenses for such transactions.
• 3.EMD amount as shown in bid document shall be paid in the form of Bank Guarantee/DD in the n ame of concerned consignee and proof of the same shall be uploaded along with bid.Manufacturer MSME/ OEM of Minimum 50% of bid items of same categories of item will be given Exemption from payment of EM D and not resellers of OEM as per Govt Policy.
• 4.Payment will be made after inspection and acceptance of items by Board of Officers respective.
• 5.Non black listed certificate from any Govt/PSU uploaded on GeM portal. Upload the same on Not arised stamp paper Rs 100/- (hundred rupees). Signature on stamp paper should not be earlier more than six mo nths
• 6.Bidder has to submit certificate regarding acceptance of all the terms and conditions and also bi dder ha s to submit Experience, Past Performance, Bidder Turnover, GST 3B three financial year, OEM Turn over, O EM Authorization, Warranty Certificate, MII as per specified format, MSE/MSME, EMD exemption as applica ble, Firm documents such as Pan Card, NEFT Mandate duly verified by Bank, Firm GST IN and Canc elled C heque.
• 7.OEM must provide Escalation Matrix of dealer in Madhya Pradesh for Service and Support .
