OPTION CLAUSE: The Purchaser reserves the right to increase or decrease the quantity to be ordered up to 25 percent of bid quantity at the time of placement of contract. The purchaser also reserves the right to increase the ordered quantity up to 25% of the contracted quantity during the currency of the contract at the contracted rates. The delivery period of quantity shall commence from the last date of original delivery order and in cases where option clause is exercised during the extended delivery period the additional time shall commence from the last date of extended delivery period. The additional delivery time shall be (Increased quantity ÷ Original quantity) × Original delivery period (in days), subject to minimum of 30 days. If the original delivery period is less than 30 days, the additional time equals the original delivery period. The Purchaser may extend this calculated delivery duration up to the original delivery period while exercising the option clause. Bidders must comply with these terms.

Scope of supply (Bid price to include all cost components) : Only supply of Goods

Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

ISO 9001: The bidder or the OEM of the offered products must have ISO 9001 certification.

The bidder is required to upload, along with the bid, all relevant certificates such as BIS licence, type test certificate, approval certificates and other certificates as prescribed in the Product Specification given in the bid document.

To be eligible for award of contract, Bidder / OEM must possess following Certificates / Test Reports on the date of bid opening (to be uploaded with bid): AIOTA and BIFMA should be visible on website, ISO issued by NABCB accredited organization .

• 7.Sample Clause After award of contract – Successful Bidder shall have to get advance sample approved from buyer before bulk manufacturing / starting bulk supplies. Successful Bidder shall submit 1 samples for Buyer's approval, within 7 days of award of contract. Buyer shall, as per contract specifications framework, either approve the advance sample or will provide complete list of modification required in the sample within 7 days of receipt of advance sample. Seller shall be required to ensure supply as per approved sample with modifications as communicated by Buyer. If there is delay from buyer side in approval of advance sample – the delivery period shall be refixed without LD for the period of delay in sample approval. In case, the sample is found to have major deviations / not conforming to the Contract specifications, the buyer at its discretion may call for fresh samples for approval before allowing bulk supplies or may terminate the contract after notifying the deviations to the seller. Unless otherwise provided in the contract, all samples required for test shall be supplied by the contractor free of cost. Where under the contract, the contractor is required to submit an advance sample, any expenses incurred by the contractor on or in connection with the production of stores in bulk, before the sample has been approved unconditionally shall be borne by the Seller and he shall not claim any compensation in the event of such sample being found unacceptable by the Buyer / Consignee.

Bidders can also submit the EMD with Account Payee Demand Draft in favour of HQ CWE Agra payable at Agra . Bidder has to upload scanned copy / proof of the DD along with bid and has to ensure delivery of hardcopy to the Buyer within 5 days of Bid End date / Bid Opening date.

Buyer Added text based ATC clauses BUYER BID SPECIFIC ADDITIONAL TERMS AND CONDITIONS

• 1.Bidder must upload following documents along with the bid as ATC documents.
• (a)PAST PERFORMANCE The Bidder or its OEM {themselves or through re-seller(s)} should have supplied same or similar C ategory Products for 30% of bid quantity, in at least one of the last three financial years before the bid ope ning date to any Central / State Govt Organization / PSU / Public Listed Company. Copies of relevant contr acts (proving supply of cumulative order quantity in any one financial year) to be submitted along with bid in support of quantity supplied in the relevant financial year
• (b)BIDDER TURN OVER The minimum average annual financial turnover of the bidder during the last three years, ending o n 31st March of the previous financial year, should be as indicated in the bid document is required. Docum entary evidence in the form of certified Audited Balance Sheets of relevant periods or a certificate from the Chartered Accountant/ Cost Accountant indicating the turnover details for the relevant period shall be uplo aded with the bid. Kindly upload last three years financial turnover duly certified by CA.
• (c)COMPLIANCE OF BOQ OEM/Manufacturer/bidder confirms in writing on their letter pad that they will match and deliver th e exact technical specification required in bid.
• 2.Product specific Certifications required : - ISO 9001:2015, ISO 1400 1:2015, ISO 45001:2018, I SO 50001:2018 (All the ISO certificates should be obtained from NABCB accredited organization otherwise certificate will not be accepted), & BIFMA (The OEM should have international membership with BIFMA, an d the company's details should be displayed on BIFMA's official website), AIOTA (Seating System Range, M odular Furniture Range, office Furniture Range should b e displayed on AIOTA's official website) & IGBC Ce rtificate to be enclosed in bid while participating which are offered by the seller against the bid. Buyer can cross verify the same on internet. In case of any deviation found, the offer is liable for rejection.
• 3.OEM Authorization certificate to authorized reseller is mandatory to be uploaded along with the bid for technical evaluation process.
• 4.Warranty / Guarantee for 1 year to be declared by OEM (Original Equipment Manufacturer) / bidder from the date of installation. The Warranty / Guarantee must cover all parts of the equipment. Undertaking to be attached on OEM letter head during technical evaluation and failing in same may cause rejection in p articipation of bidder.
• 5.Bidder must submit product catalogue/data sheet for each product
• 6.Approved Makes by the E-in-C / Command / Zone office are only allowed to quote the bid with their valid approval and renewal letters to be uploaded by the bidder.
• 7.Details of after sale service support from OEM should be provided which will include following: - (a) address of service center; (b) Telephone No.(Office) and (c) Name of Authorized Service Engineers along w ith mobile number & e-mail address. BIDDER/OEM must have Dedicated/toll Free Telephone No. for Servic e Support. -2-

• m.In case of limited company, copy of registration certificate issued by Registrar of companies must be up loaded.
• 9.Declaration for no blacklisting: The Tendered/bidder shall upload declaration for no blacklisting on Non-Judicial Stamp paper of Rs. 100.00 duly Notarized and Rs. 1.00 Revenue Ticket pasted on it must be u ploaded.
• 10.Bidder should confirm regarding specification of items as mentioned in BOQ and ATC u ploaded with the bid.
• 11.The buyer reserves the right to cancel/reject the bidder offer if the bidder doesn’t upload any of the certificates / documents sought in the Bid, as asked in terms and condition, ATC and Corrigendum if any. .
