Bidder's offer is liable to be rejected if they don't upload any of the certificates / documents sought in the Bid document, ATC and Corrigendum if any.

Successful Bidder can submit the Performance Security in the form of Fixed Deposit Receipt also (besides PBG which is allowed as per GeM GTC). FDR should be made out or pledged in the name of WCL, WANI NORTH AREA A/C (Name of the Seller). The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of Security Deposit, the FDR will be released in favour of bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.

• 1.Inspection: - Inspection will be done by Colliery Engineer (E&M), Ukni OC Min e during progress of work / completion of work.
• 2.The tenderer is advised to see the quantum of work / site condition before sub mission of tender to avoid Further complications.
• 3.Completion Period: - The total completion period of the work shall be 45 (Fo rty Five) days from the date of handing over of conveyor roller M.S. Black Pipe (114.3 mm OD) by WCL.
• 4.The rates once awarded will remain firm for the entire period of contract / agr eement.
• 5.The total amount shall be quoted including GST in the GeM Portal.
• 6.The tenderer cannot transfer / sub let any part of work.
• 7.Transportation: - Transportation of all materials shall be the responsibility of contractor.
• 8.Payment of Bill: -90 % payment will be made within 21 days after submissio n of bill and balance 10 % will be paid after satisfactory performance for a peri od of six months from the date of installation or 09 (Nine) months after date of delivery, whichever is earlier.
• 9.Guarantee: -The work should be guaranteed for a period of six months from t he date of installation or 09 (Nine) months after date of delivery, whichever is earlier. In case of pre-mature failure of the job within the guarantee period the same will be repaired free of cost by the contractor within 15 days from the da te of joint inspection as per instructions of Engineer In-charge.
• 10.Paying Authority: - Area Finance Manager, WCL, Wani North Area.
• 11.Bill should be submitted through Colliery Engineer (E&M), Ukni OC Mine / SAM , Ukni-Junad Sub Area to S.O. (E&M), Wani North Area with necessary certificati on of satisfactory completion of work.
• 12.Scope of work: - Pipe (114.3 MM OD) for the repairing work will be provided by WCL, providing of items like roller shaft of required size, repair kits with bea ring, circlip etc. with labour charges shall be the responsibility of the repair / co ntractor. Note :- Complete scrap if any is to be returned by the bidder to Ukni OC Mine, Wani North Area WCL.
• 13.Liquidated Damages Clause: - If the contractor fails to maintain the require d progress in terms of the agreed time &progress chart or to complete the wor k on or before the scheduled date or extended date of completion, he shall, wit hout prejudice to any other right or remedy available under the law to the com pany on account of such breach, pay as compensation (Liquidated Damages) @ half percent (1/2 %) of the contract price per week of delay. The aggregate of such compensation / compensations shall not exceed 10% (Ten) percent of t he total value as shown in the contract.
• 14.Force Majeure clause: - If the execution of the work by the tenderer / bidder is delayed beyond the period stipulated in the contract / work order as a result of outbreak of hostilities, declaration of an embargo or blockade or fire, flood, a cts of nature or any other contingency beyond the tenderer / bidders control d ue to Act of God, then Western Coalfields Limited may allow such additional ti me by extending the delivery period, as it considers to be justified by the circu mstances of the case and its decision shall be final.
• 15.The management reserves the right to accept / reject any or all tenders, split the work amongst more than one tenderer without assigning any reason whats oever.
• 16.All the corrigendum and amendments issued on website or otherwise from thi s office regarding this NIT shall be responsibility of the tenderers to comply wit

h.

• 17.Extension of Completion period: - If the execution of work by the tenderer is delayed beyond the stipulated period due to delay in handing over the work s as mentioned. WCL may allow such additional time by extending the comple tion period.
• 18.If any tenderer declines to execute and carry out the work after acceptance of their tender, without prejudice, WCL, shall have right to terminate the work or der after forfeiting the EMD and taking any other action deemed fit without ass igning any reason whatsoever.
• 19.Engineer-Incharge: Sub Area Manager, Ukni-Junad SA or his authorized represent ative will be Engineer-Incharge for this work.
• 20.Termination of Contract: -The company shall, in addition to other remedial steps to be taken as provided in the conditions of contract be entitled to cance l the contract in full or in part, if the contractor: - Makes default in proceeding with the works with due diligence and continues t o do so even after a notice in writing from Engineer-In-charge, then on the expi ry of the period as specified in the notice. Or Commits default/ breach in complying with any of the terms and conditions of the contract and does not remedy it or fails to take effective steps for the reme dy to the satisfaction of the Engineer-In-charge, then on the expiry of the perio d as may be specified by the Engineer-In-charge in a notice in writing. .
