OPTION CLAUSE 25% : The buyer can increase or decrease the contract quantity or contract duration up to 25 percent at the time of issue of the contract. However, once the contract is issued, the contract quantity or contract duration can only be increased up to 25 percent. Bidders are bound to accept the revised quantity or duration. Buyer Added text based ATC clauses Contract of Hiring transport would be for: Sedan: Maruti Suzuki Dzire, Honda Amaze, Tata Tigor, Ciaz or equivalent. SUV: Mahindra Scorpio, Mahindra Bolero, Mahindra XUV 700 or equivalent. MUV: Toyota Innova, Tata Safari or equivalent. Contract period of hiring transport would be eighteen months, commencing from the date of cont ract order. The vehicles when hired may need to report (start of journey) at any time of a day, 24x7 and eve n on holidays. The Successful bidder shall be liable to supply vehicle(s) even on Sunday/holidays. The Successful bidder shall have to change the driver / vehicle if the same is found unfit / inconv enient by the user. The starting point of duty (pickup point) will be Tezpur in most of the cases. However, some dutie s may have starting point from Guwahati/Siliguri/Bagdogra. When contract is commenced, hiring of vehicles will be on ‘as and when required basis’. Hiring of multiple vehicles may be required in certain occasions. Each duty will be combination of multiple sectors/items/categories in most of the occa sions/requirements. The duty will comprise of onward trip/trips, duty point trip/trips a nd return to station trip/trips in most of the cases. Each category/trip will be completed in the same day and same will not carryover to subsequent day. However, if duty starts after 1800hrs (reporting time), continues and completes within 0600 hrs of subsequent day; hiring charges will be counted for only one day/unit. Depending upon the road conditions and terrain, on certain occasions the vehicles deployed shou ld have 4x4 wheel drive capability. Night halt (if any) charges will be borne by supplier. It is mandatory for vendors/bidders to quote for all sectors/categories else the bid will be rejected. The rates quoted should be inclusive of GST, all taxes and charges. Least quote (L1) will be based on overall cost comprising the sum of total charges for all s ectors/categories/items. The rates shall remain firm during the contract period. No escalation or price variation or any othe r extra payment whatsoever and on any account shall be made/ allowed irrespective of any fluctu ation in fuel prices/ taxes or labour/ material or even in wages of the drivers etc. The payment shall be made on as and when utilized basis, based on details mentioned in vehicle duty slip. Payment calculation will be made based on the duty slip signed by the user and driver which shall indicate the opening and closing meter reading and time with vehicle registration nu mber. No payment shall be made in advanced nor any loan from any bank or financial institution recom mended on the basis of the order of award of work. Vehicle must be in the name of firms/service provider/proprietor. Else, agreement must be there between firms/service provider/proprietor and vehicle owner for usage of vehicle by firms/service provider/proprietor for supply in hiring purpose. RC copy of one sedan and one SUV/MUV must be submitted. Registration of vehicle should not be more than 5 years old as on the date of opening of Tender. The vehicle to be supplied should have valid registration for commercial uses. All road tax, registration, income tax as applicable, to be paid are to be borne by the contractor. F or inter-state movement, the contractor has to arrange vehicle having inter-state permit and no e xtra payment will be made by DRL. The vehicle to be provided during hiring must be road worthy condition and must have valid regis tration certificate, insurance certificate, PUC, etc. which are mandatory for plying of vehicles. Vehicle should be in excellent working condition (both internally and externally) at all times. The service provider shall ensure that the vehicles deployed by him are cleaned thoroughly both inter nally and externally, boot kept clear of dust, rubbish, oil, bad odor and any personal belongings o f the driver. The toll charges and parking fees will be borne by the supplier /bidder. Vendor/supplier should be well conversant to ply vehicles in hilly, high altitude, landslide and rain fall conditions of Arunachal Pradesh. Accordingly, driver should be well conversant with roads and routes. The tenderer/contractor should maintain a Vehicle duty slip/log book for entering starting kilomet er reading, ending kilometer reading, starting time and date, ending time and date. Data recorde d will be verified by the user. The service provider must ensure that all necessary measures are taken by the driver to ensure p assenger safety by avoiding negligent driving by their drivers such as over speeding, rash driving , and driving vehicle without brakes/defective brakes. All the expenditure incurred in repairs and maintenance shall be borne by the contractor. Cost of fuel, lubricating oil or any other consumables shall also be borne by the contractor. No mileage will be allowed for lunch/tea etc. to the driver. The drivers are not allowed to take hire d vehicles for their personal lunch and/or tea during duty hours. In case of any mishap/accident, all the claims arising out of it, shall be met by the vehicle provide

• r.In the event of break-down of the hired vehicle which could not be used further, it will be the resp onsibility of service provider/firm to arrange an alternate vehicle. No extra charge will be borne b y buyer. In such a case, mileage from garage to the point of breakdown would not be paid. The drivers of the vehicles deployed should maintain polite & courteous behavior towards the buy er/passenger. “Misbehavior” which may include, but not limited to, consumption of alcohol during or prior to duty, denial of duty during service hours as defined by user, use of abusive language, theft, shall attract penalties as per provisions of the contract. The driver shall be reachable at all times during duty hours. Driver must possess a working mobil e phone whose number should be given to user by service provider. The drivers of the vehicles must possess a valid driving license. All vehicles shall be equipped with an emergency medical First Aid kit. The vehicles shall be made available with sufficient fuel, before the driver reports for duty. Odometer (digital/analog) should always be in working condition and should not be tempered. Penalties and deductions:
• i.Unclean vehicle, unhygienic, untidy or seat covers/ smell in the vehicle: @ Rs. 300/- per day. ii. For non-providing of vehicle in time: a penalty of @ Rs.500/- per 15 minutes of delay on each occasion/day. iii. On misbehavior by the Driver: @ Rs.500/- per occasion. iv. Unsafe / Rash driving:@Rs. 500/- per occasion.
• v.Driver in intoxicated state:@ Rs. 2000/-. vi. If vehicle breakdown occurs, replacement must be provided. If replacement is not provided wit hin 2 hours, then penalty will be charged @ 500/- per every 30 minutes delay. Subject to maximu m penalty of Rs. 5000/- per day hiring. .

Successful Bidder can submit the Performance Security in the form of Fixed Deposit Receipt also (besides PBG which is allowed as per GeM GTC). FDR should be made out or pledged in the name of Centre Head,DRL A/C (Name of the Seller). The bank should certify on it that the deposit can be withdrawn only on the demand or with the sanction of the pledgee. For release of Security Deposit, the FDR will be released in favour of bidder by the Buyer after making endorsement on the back of the FDR duly signed and stamped along with covering letter. Successful Bidder has to upload scanned copy of the FDR document in place of PBG and has to ensure delivery of hard copy of Original FDR to the Buyer within 15 days of award of contract.

Participation by the bidder in RA process would be considered as their consent for extension in offer validity by 30 days by the date of RA initiation.
